HomeMy WebLinkAboutSp Ex AnalysisAnalysis for Special Exception as a component of a Major Use Special Permit for the ISLAND GARDENS AT WATSON ISLAND Located at Northwest Quadrant of Watson Island CASE NO. 2004-0810 Pursuant to Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, the subject proposal for the Island Gardens AT Watson Island Project has been reviewed to allow the following Special Exceptions: • Special Exception per Article 4, Section 401 to a fish market and restaurant with 7,800 square feet with city commission approval uses within the PR zoning district. • Special Exception per Article 4, Section 401 to allow marinas within the PR zoning district. • Special Exception per Article 4, Section 401 to allow rentals and charters within the PR zoning district. • Special Exception per Article 4, Section 401 to allow retail specialty shops including retails sales of boating, fishing, diving and swimming supplies and equipment within existing the PR zoning district. • Special Exception per Article 4, Section 401 to allow outside display and boats only within the C-1 zoning district. • Special Exception per Article 9, Section 915.2, for FAA clearance letter within existing PR zoning district. • Special Exception per Article 9, Section 917.1.2, to allow restaurant parking facilities maintained with valet parking up to fifty (50) percent of the required off-street parking spaces within existing PR zoning district. The requested Special Exceptions are a component of a Major Use Special Permit for the Island Gardens at Watson Island Project to be located on northwest quadrant at Watson island. The proposed project will consist of a mega yacht marina and mixed -use development consisting of the following; two hotels with a combined total of 605 hotel rooms; 221,000 square feet of retail space which will include 61,494 square feet of restaurant space; a 50 wet slip mega yacht marina with 2,500 square feet chandlery for marina guest use; a 4,000 square feet of maritime gallery and a 7,774 square feet of fish market with restaurant (see attached legal description, location maps and aerial photographs for exact property boundaries). NOTE: These Speeial Exceptions encompasses the following Class II and Class I Special Permits: Class II Special Permit as per Determination of Use 2001-001, Special Exception to permit establishments which offer time-share licenses within the C-1 "Restricted Commercial" zoning district. Class II Special Permit as per Article 15, Section 1511, to allow development between Biscayne Bay and the first dedicated right of way. Class II Special Permit as per Article 9, Section 903.1, to allow development of project divided by a street. Class II Special Permit as per Article 4, Section 401, to allow construction fence and covered walkway. Class II Special Permit as per Article 4, Section 401, to allow the repair or servicing of boats, marine motor or marine accessories and equipment. Class II Special Permit as per Article 10, Section 10.2.1, to provide for signage approval. Class II Special Permit as per Article 4 Section 401, to allow for wholesale activities at the ground floor level along designated primary pedestrian pathways so long as ground floor square footage consist of retail open to the public. Class II Special Permit as per Article 4, Section 401, to allow for outdoor eating areas, outdoor cafes, outdoor display and sale of food or live flowers and plants. Class II Special Permit as per Article 4, Section 401 to allow privately owned and/or operated museums and the like. Class II Special Permit as per article 9, Section 906.9, to allow for special event namely a groundbreaking ceremony. Class I Special Permit to permit staging and parking during construction (to be approved prior to obtaining a building permit from the Department of Planning and Zoning). Class I Special Permit as per Article 9, Section 925.3.8, to allow development/construction/rental signage. Class I Special Permit as per Article 9, Section 918.2, for parking staging of construction during construction. Class I Special Permit as per Article 9, Section 920.1, to allow a trailer and watchman's quarters. Class I Special Permit as per Article 9, Section 917.1.2, to allow a trailer(s) for construction and other temporary offices such as leasing and sales. Class I Special Permit as per Article 9, Section 917.1.2, to allow valet parking including buses and other vehicles. Designation as phased project, pursuant to Article 25, Section 2502 of Zoning Ordinance 11000. The following findings have been made: • It is found that the proposed development project will benefit the City of Miami by creating a new major attraction and destination facility on Watson Island to be enjoyed by city residents and visitors alike. • It is found that the subject of this Special Exceptions. specifically, the approval of retail and restaurant, mega yacht marina and hotel uses as a component of the proposed project, is completely within the scope and character of this significant parcels on Watson Island. • It is found that with respect to all additional criteria as specified in Section 1305 of Zoning Ordinance 11000, the proposal has been reviewed and found to be adequate. • It is found that due to the location of the proposed project along Biscayne Bay, the applicant shall be required to present the project to the Miami -Dade County Shoreline Development Review Committee for review and approval; the City of Miami shall require a final Resolution from said Committee prior to issuance of a building permit for the project. Based on these findings, the Planning and Zoning Department is recommending approval of the requested Island Gardens at Watson Island Project with the following conditions: 1. The approval of this Major Use Special Permit shall be subject to the recordation of the Development Order specifying that the Development Order runs with the land and is binding on the Applicant, it successors and assigns, jointly or severally. 2. The Lessee, Flagstone Island Gardens, LLC, shall comply with the Lease and. Development Agreement with the City of Miami. 3. Pursuant to the requirements of Miami -Dade County, the proposed project shall require the review and approval of the Shoreline Development Review Committee prior to the issuance of a building permit for the project. 4. This approval shall also be subject to all additional conditions specified in the Final Development Order for the project.
