ENCLOSURES:
This memorandum respectfully requests placement of an item on the June 24, 2004 City Commission
Agenda for the Civilian Investigative Panel (CIP) to provide a status report to the Mayor and
Commission. As you have been previously informed, the CIP has yet to become fully operational and
respectfully requests this opportunity to update the Mayor and City Commission.
Background:
With the passage of the CIP ordinance on February 14, 2002, staff from the Office of Professional
Compliance was designated as transition staff, providing administrative support to include
management of the screening and selection process as well as identification of an office site consistent
with the needs of the Panel. Impaneled by February 2003, the move into the present office space was
accomplished in April of the same year.
Not as easy to accomplish however, were resolutions on issues regarding organization, authority,
autonomy, line(s) of communication, staffing and resource allocation. Specifically, matters pertaining
to budget, employee status, classification, recruitment, selection and salaries were the subjects of a
series of meetings with City administrators, all made more difficult by the lengthy simultaneous
process of defining just how autonomous a board was called for by the ordinance and the mandate.
After numerous meetings with the Chief of Strategic Planning, Budgeting & Performance, the C1P
agreed to a compromised budget of $674,073 with the caveat that mid -year adjustments would be
necessary if the office became fully operational by the first half of the Fiscal Year.
The CIP's position is that many of the developmental and logistical issues faced since its inception
should have been contemplated and/or in place prior to empanelment. The panel's focus and mandate,
and in particular its investigative function, have been significantly delayed as city administrative staff
and CIP members struggle to balance the concerns of administrators with the needs of the office within
the meaning and intent of the ordinance.
The CIP in its resolve to accomplish its mandate, requests an opportunity to present a status report to
the Mayor and City Commission that will incorporate the issues and concerns cited in this
memorandum.
