A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
APPROVING THE CITY OF MIAMI'S ("CITY") PUBLIC HOUSING AGENCY ("PHA")
PLANS WHICH INCLUDE THE FIVE-YEAR PLAN FOR FISCAL YEARS 2005-2009,
AND THE ANNUAL PLAN FOR FISCAL YEAR 2004, IN CONNECTION WITH THE
IMPLEMENTATION AND ADMINISTRATION OF THE CITY'S SECTION 8
MODERATE REHABILITATION HOUSING PROGRAM, AS SET FORTH IN THE
HOUSING CHOICE VOUCHER PROGRAM ADMINISTRATIVE PLAN, ATTACHED
AND INCORPORATED; AUTHORIZING THE CITY MANAGER TO SUBMIT THE PHA
PLANS, ATTACHED AND INCORPORATED, FOR REVIEW AND APPROVAL BY
THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT
("HUD") FOR THE CITY'S CONTINUED PARTICIPATION IN THE ABOVE
MENTIONED FEDERAL RENTAL ASSISTANCE PROGRAM, AS SET FORTH IN
THE HOUSING CHOICE VOUCHER PROGRAM ADMINISTRATIVE PLAN,
ATTACHED AND INCORPORATED; AUTHORIZING THE CITY MANAGER TO
EXECUTE ANY AND ALL DOCUMENTS AND CERTIFICATIONS REQUIRED, IN
SUBSTANTIALLY THE ATTACHED FORMS, AND IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, FOR SAID PURPOSE; FURTHER ALLOCATING SECTION 8
MODERATE REHABILITATION PROGRAM FUNDS, IN THE AMOUNT OF
$3,100,000, FOR FISCAL YEAR 2004.
WHEREAS, effective October 1, 1999, Section 8 of the United States Housing Act of 1937, was
amended by the Quality Housing and Work Responsibility Act of 1998, requiring public housing
agencies to develop plans that include a five-year strategic plan and an annual plan; and
WHEREAS, the City of Miami ("City") has been designated as the Public Housing Agency ("PHA")
to administer the Section 8 Moderate Rehabilitation Housing Program; and
WHEREAS, the Five -Year Plan for Fiscal Years 2005-2009 describes the City's mission, long
range goals and objectives to address the needs of low and very low-income families; and
WHEREAS, the Annual Plan for Fiscal Year 2004 provides details and examines immediate
operations, participants, program and services, and the City's strategy for handling operational
concerns, residents' concerns and needs, programs and services for the upcoming fiscal year; and
WHEREAS, submission of the PHA Plans to the United States Department of Housing and Urban
Development ("U.S. HUD") is required to ensure the City's continued participation in the Section 8
Moderate Rehabilitation Housing Program as set forth in the Housing Choice Voucher Program
Administrative Plan, attached and incorporated;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this section.
Section 2. The City's PHA plans, which include the Five -Year Plan for Fiscal Years 2005-2009 and
the Annual Plan for Fiscal Year 2004, in connection with the implementation and administration of the
City's Section 8 Moderate Rehabilitation Housing Program, as set forth in the Housing Choice
Voucher Program Administrative Plan, attached and incorporated, are approved.
Section 3. The City Manager is authorized to submit the PHA Plans, attached and incorporated,
for review and approval by HUD, for the City's continued participation in the above mentioned federal
rental assistance program.
Section 4. The City Manager is authorized{1} to execute any and all necessary documents and
certifications required, in substantially the attached form, and in a form acceptable to the City
Attorney, for submission of the City's PHA Plans to HUD.
Section 5. The allocation of Section 8 Moderate Rehabilitation Housing Program funds, in the
amount of $3,100,000, for Fiscal Year 2004, is authorized.
Section 6. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
