Cr r 3de Arriola anager DATE: SUBJECT: REFERENCES: ENCLOSURES: NOV 4 2003 Ordinance — Impact Fee Exemptions FILE : RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached Ordinance to amend The Development Impact Fees as provided for in Chapter 13, Article I of the City of Miami Code, as amended, by establishing a conditional and limited exemption for Residential development within the "West Brickell Exemptible Zone" (Zone), bounded by 15th Road on the South, SW 15t Avenue on the West, Miami River on the North, Brickell Avenue on the East to SE 8th Street, west on SE 8th to Brickell Plaza, south on Brickell Plaza to South Miami Avenue, south on South Miami Avenue to 15th Road, west on 15th Road to SW lst Avenue, graphically described in Exhibit "A". BACKGROUND The City of Miami Downtown/Brickell area has become, in the last few years, an international commercial and financial center directly competing with the great metropolitan centers both in the United States and abroad. The Miami City Commission, on May 22, 2003 adopted by Resolution 03-588, the Miami Downtown Transportation Master Plan (Plan). The "Plan" recognizes that to promote continued economic opportunities for the area and ensure the creation of a 24-hour urban environment it is vital to provide measures to alleviate the traffic congestion originated by high -density projects. Growth of this urban center as a 24-hour community has been evident in recent years as new developments have been constructed, mainly in the Brickell area contiguous to Downtown. As traffic constraints have become a source of concern to the business community, residents and City leaders it has become a priority to seek solutions. Given the constraints imposed by limited rights -of -way, buildings abutting the same and current traffic volumes far in excess of available capacity, an appropriate incentive is to exempt Residential development as defined in Zoning Ordinance 11000, as amended, having a valid building permit approved and issued between November 15, 2003, and November 15, 2004, that does not exceed 50% of allowable floor area ratio as specified for each zoning district contained in Zoning Ordinance 11000, as amended, from the imposition of Development Impact Fees associated with new development within the City. FISCAL IMPACT The proposed Ordinance will result in a reduction of the impact fees received by the City. Given that impact fees are calculated based on the individual design and use of each project, we are unable to determine the fiscal impact to the City's Budget. LH/ • C
