As President of the Miami -Roads Neighborhood Civic Association, I request that
the City Commission postpone and defer the "First Reading" of "Proposed Ordinance
FR.1 - 03-0112 (described as "West Brickell Impact Fee Exemptible Zone") that is
scheduled for Thursday, November 13, 2003. The first time that the Miami -Roads
Neighborhood Association became aware of this Proposed Ordinance was on
November 10, 2003. Based upon our initial reading of this Ordinance, we have many
concerns and serious objections.
The Association requests this deferment so that it may have the time and ability
to look at the Proposed Ordinance in greater detail. We presently question: (1) the
reasons for this "Exemption"; (2) the precedent created by such an exemption; (3) how
the City will be able to afford to pay for the impact that will most assuredly result from
the planned development in the subject area, and in particular, for the many services
that will be significantly affected by the development that will be benefitted by this
"unique" legislation. We have many other questions regarding potentially detrimental
effect on the residents and property owners in the affected area, which is not only the
one described in the Proposed Ordinance, but thousands of others that depend upon
the same Fire and Rescue, Police, Schools, etc.
We presently have two Commissioners whose constituency are members of our
Association. Commissioner Winton represents the area of the Roads where I live
(South Miami Avenue by Vizcaya), and Commissioner Sanchez who represents the
other side of the Roads from First Avenue and thereon. We cannot imagine that either
of them would give their blessings to something that could very well turn out to be gross
fiscal irresponsibility. The desire to provide incentives to developers should never be
at the expense of the neighbors of any area. One can understand the City's desire to
seek development in depressed sections of the City, which clearly would provide
benefits to the City, and in that case, to the residents of the neighboring areas.
However, the area affected by Proposed Ordinance FR.1 - 03-0112 is one of the most
desirable areas in the City of Miami at the present time, hence, this "bonanza" to
developers is incomprehensible.

The Association respectfully requests a continuance or deferment of the First
Reading of this Proposed Ordinance to a future date, so that its members may have the
opportunity to fully evaluate and understand the matter. If this continuance is granted,
we would like to know of the rescheduled date well in advance of that hearing. If the
matter is not continued, let this serve as the Association's Notice to the Commission at
Large that the Miami -Roads Neighborhood Civic Association vigorously objects to
Proposed Ordinance FR.1 - 03-0112, better described as "West Brickell Impact Fee
Exemptible Zone."
