ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING CHAPTER 35/ARTICLE IV, ENTITLED
"MOTOR VEHICLES AND TRAFFIC/PARKING RATES",
OF THE CODE OF THE CITY OF MIAMI, FLORIDA,
AS AMENDED, BY: (1) ESTABLISHING A MONTHLY
ON -STREET PERMIT PROGRAM; (2) PROVIDING
CITY OF MIAMI EMPLOYEES WHO RESIDE WITHIN
THE CITY A DISCOUNT FOR THE PURCHASE OF A
MONTHLY PARKING PERMIT; (3) AUTHORIZING
RATES AND FEES FOR BAGGED METER/METERED
SPACE RENTALS; (4) PROVIDING FOR METER
REMOVAL; (5) AUTHORIZING A RESTRICTED
RESIDENTIAL PARKING PROGRAM; AND (6) BY
INITIATING RATES FOR NEW FACILITIES DURING
THE FISCAL YEAR; MORE PARTICULARLY BY
AMENDING SECTIONS 35-191, 35-192, AND 35-
193, AND BY ADDING NEW SECTIONS 35-194, 35-
195 AND 35-196 TO THE CODE; CONTAINING A
REPEALER PROVISION, A SEVERABILITY CLAUSE
AND CONTAINING AN EFFECTIVE DATE.
WHEREAS, the Off -Street Parking Board of the City of Miami,
requested the Director of the Department of Off -Street Parking to
submit an Amendatory Ordinance to the City Commission to
recommend changes to selected on -street parking meter zones, and
municipal garage rates, fees, time limits, and regulations,
Which, as more specifically provided within the text of this
ordinance to become effective as provided by law; and
WHEREAS, the City Commission of the City of Miami, at the
request of the Off -Street Parking Board, does hereby establish
that these modified rates will be effective as provided by law;
and
WHEREAS, it is in the best public interest of the parking
system patrons and the City to modify parking rates from time to
time to reflect current market conditions; and
WHEREAS, Florida law allows the City to establish reasonable
rents, rates, fees, charges and impositions, and it is in the
City's best public interest to continue authorizing fees for
metered space rentals which deprive the public of the use of a
metered space, and
WHEREAS, the City Commission finds it is in the best public
interests to delegate to the Off-street Parking Board, the local
legislative body that most closely supervises parking in the
City, the ability to adjust the rates, subject to this Chapter;
and

WHEREAS, the City Commission of the City of Miami finds it
to be in the best public interest to establish a residential
permit parking program in certain areas of the City which are
entirely or predominantly residential and for which the
neighborhood residents are in need of residential parking
assistance and relief from parking congestion;
WHEREAS, the City Commission of the City of Miami finds to
be in the best public interest to afford City employees whom are
City residents one discounted parking permit so as to encourage
City of Miami employees to live within the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Chapter 35, entitled "Motor Vehicles and
Traffic, Article IV, entitled "Parking Rates," of the Code of the
City of Miami, Florida, as amended, is amended in the following
particulars:1/

Sec. 35-191. On -street parking meters; and
Monthly On -street Permit Program;
On -street parking meters:
(a) The maximum hourly rate of charge, and fees for
parking in metered spaces in on -street parking
meter zones, and on -street monthly permit zones,
except as otherwise provided herein, are as
follows:

Monthly On -Street Permit Program:
(b) The monthly on -street permit program is available,
in certain areas of the City, pursuant to this
Chapter, on a first -come, first -serve space
available basis. Permits are to be issued by the
Department of Off -Street Parking. The Executive
Director is expressly authorized to implement this
program and shall oversee and develop these
special on -street parking permit areas as they are
deemed necessary by the Director where the
Director determines that sufficient off-street
parking facilities are not available in an area to
accommodate monthly parking demand. Such areas
will be subject to all applicable laws,
resolutions, rules and guidelines governing their
operation established by the City Commission
and/or Board/Department Of Off -Street Parking.
All monthly parking patrons are required to renew
and pay for their monthly parking permits, in
advance, no later than the third day of each
month. If payment in full is not received by the
third day of the month, then the permit is
automatically invalidated without the necessity of
further action. Monthly on -street parking permits
for these special parking areas can be purchased
for up to 12 months at a time. At no time shall
such parking permits be sold for a period longer
than 12 months, unless a longer time period has
been allowed by law.
(c) City of Miami employees who reside within the City
will be able to receive a twenty -percent (20%)
discount towards the purchase of one monthly
permit (1 permit), as long as they remain

eligible. Each additional permit will be sold at
regular price.
Sec. 35-192. Municipal parking garages.
(a) The maximum rates of charged and fees charged for
parking in off-street municipal garages are as
follows (all rates include atatc sales tax unlcaa

Sec. 35.194. Metered Space Rentals; Bagged Meter
Fees.
(a) The maximum rates and fees charged for metered
space rentals and bagged meters are as follows (all
rates exclude parking surcharge and all applicable
sales tax) :
(1) Administrative Processing Fees:
The administrative fees for the processing of all
metered parking space rental permits are set forth
herein and may be amended from time to time, by the
City Commission. The administrative fee is in addition
to any fee paid for parking stalls, meter bags, or
linear curb space.
The Administrative Fee structure is as follows:
a. $20.00 administrative fee assessed for
any meter rental of five (5) meters or
less.
b. $25.00 administrative fee assessed for
any meter rental of from six (6) to ten
(10) meters.
c. $30.00 administrative fee assessed for
any meter rental of eleven (11) meters
or more.
(2) Bagged Meter Fees:
The rate is $10.00 per meter, or for every twenty
linear feet, per day. The fees are set forth herein and
may be amended from time to time by the City
Commission.

(3) Metered Parking Space Rental Fee:
The rate is $10.00 per meter, or for every twenty
linear feet, per day. The fees are set forth herein and
maybe amended from time to time by the City Commission.
(4) Bagged Meters for Production and Film Use:
The Department Of Off -Street Parking may provide bagged
meters on an as -needed basis within the sole discretion
of Department Of Off -Street Parking, taking into
account the parking needs of the City, bagged meters to
accommodate production, staff, and film needs. A copy
of a valid, City issued production/film permit must
accompany each application for bagged meter rental.
The fee per space is $10.00 per meter, or for every
twenty linear feet per day, payable twenty-four (24)
hours in advance. Only essential vehicles shall be
allowed to park at bagged meters. Crew parking can be
arranged with the Department Of Off -Street Parking.
Meter bags for production and film use shall be red in
color and shall state, "No Parking/Tow Away", and shall
be strictly enforced. The fee per meter, or for every
twenty linear feet, is $10.00 per day. The fees are set
forth herein and may be amended from time to time by
the City Commission.
(5) Bagged Meters and Parking Space Rentals for
Special Events/Construction:
The Department of Off -Street Parking may provide on an
as -needed basis, at the sole discretion of Department
Of Off -Street Parking, taking into account the parking
needs of the City, bagged meters and parking space
rental to accommodate special events, construction, and
staff. A copy of a valid, City issued Special Event
Permit and/or Building Permit, as applicable, must
accompany each application for a bagged meter rental.
The fee per space is $10.00 per meter, per day,
payable twenty-four (24) hours in advance. Only
essential vehicles used for the special event and/or
construction shall be allowed to park at bagged meters.
Parking spaces for special event or construction staff,
can be arranged with the Department of Off -Street
Parking. Meter bags for special events and
construction shall be red in color and shall state, "No
Parking/Tow Away". Meter bags may only be issued by
the Department of Off -Street Parking, and shall be
strictly enforced. The current rate is $10.00 per
meter, or for every twenty linear feet, per day. The

fees are set forth herein and may be amended from time
to time, by the City Commission.
Sec. 35.195. Meter Removal.
1) Temporary Parking Meter Removal:
The Department of Off -Street Parking may provide
for the temporary removal of parking meters to
accommodate construction and other limited needs. The
fee for the removal of the meter and post shall be
$50.00 per meter. The cost for re -installation of the
meter and pole shall be $50.00 per meter. Meter
removal and replacement shall be paid to the Department
of Off- Street Parking in advance at a rate of $100.00
per meter. Additionally, the applicable bagged meter
rental rate shall be assessed on a per space, per day
basis, payable in advance, until such time as the
parking meter is re -installed. No such removal shall
last for a cumulative period of more than ninety (90)
days during any calendar year.
2) Permanent Parking Meter Removal:
Permanent parking meter removal requests are strongly
discouraged and are granted in within the sole
discretion of the Off -Street Parking Board, consistent
with the parking needs of the City. The fee for the
permanent removal of a metered parking space shall be

Sec. 35-196. Restricted Residential Parking Program:
(1) The City of Miami City Commission hereby
establishes the following Restricted Residential
Parking (RRP) Zones. These zones are created to
protect the quality of life of the City's residents in
areas where residential parking is severely impacted by
competing uses. The Executive Director of the
Department of Off -Street Parking shall have the
authority to create rules, regulations, and guidelines
in conformity with this Section for the parking of
vehicles and the issuance of resident, visitor, or
temporary, permits within the RPP zones. The RPP zones
are hereby established as follows:

(2) Resident Parking Permits:
A restricted, residential zone resident must purchase
restricted residential permits from the Department of Off -
Street Parking. The fee for these zones will be as follows:
1) $25 per year for first vehicle
2) $50 per year for two vehicles
3) $75 per year for three vehicles
(3) Temporary Residential Guest Parking Placard/Hang
Tag Permits:
Temporary residential guest placard/hang tag
permits, authorizing guest parking in the restricted
residential zones are available from the Department of Off -
Street Parking. Such permits are to be issued for a bona
fide guest of a resident of the restricted residential
parking zones at a fee of $1.00 per day, for a maximum two -
week period during any calendar year. A restricted
residential zone resident must purchase residential guest

parking placard/hang tag permits. Temporary guest
placard/hang tag permits are only valid within the
restricted residential zone of the resident purchasing the
guest permit, and are not valid at any parking meter,
municipal parking lot, garage, or other Restricted
Residential Parking ("RRP") zone.

Section 3. All ordinances or parts of ordinances that
are inconsistent or in conflict with the provisions of this
Ordinance are repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof./
PASSED ON FIRST READING BY TITLE ONLY this 'day of

This Ordinance shall become effective as specified herein unless
vetoed by the Mayor within ten days from the date it was passed
and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City
Commission or upon the effective date stated herein, whichever is
later.
