"Development Impact Fees, In General" to Clarify Provisions Regarding the
Granting of Impact Fee Exemptions
Background: On November 19, 2002, the City Commission adopted Ordinance No.
12295 updating Chapter 13, Articles 13-2(b)(3) and (4) and 13-6(3) and (4) of the City
Code to reflect the replacement of "community development target areas" with
"community revitalization districts" as areas within which duplex and multiple family
residential development would be exempt from impact fees. This was done to reflect
policy changes formalized in the City's adopted 1999-2004 Consolidated Plan. However,
questions have been posed as to whether the revised City Code language allows for
exemptions in both "community development target areas" with "community
revitalization districts" or solely in "community revitalization districts". In light of these
questions, the City Code should be revised to clarify that exemptions are allowed solely
in "community revitalization districts". Adoption of this ordinance will eliminate undue
confusion regarding the interpretation of the City Code as it pertains to Impact Fee
exemptions.
