RE: Proposed First Readi : Ordin. ce-. .. er 23, 2003 City Commission Meeting
Amending Chapter 2, Artie X, Section 2-817(h)(3)(ii) of the Code of the City of
Miami, Florida, as am, ded, entitled "Administration, Code Enforcement,
Administrative Costs, Fin- s; Liens."
It is recommended that the attached Ordinance be adopted amending Chapter 2, Article X,
Section 2-817 (h)(3)(ii) of the Code of the City of Miami, to delete the provision that permitted
lien(s) released prior to issuance of certificates of occupancy of affordable housing projects by the
City Manager to be reinstated.
The release of liens prior to the issuance of certificate of occupancy has placed the City with
no recourse if and when affordable housing projects fail to fulfill its obligations. It has been
determined that it is not in the best interest of the City to release lien(s) for affordable housing
projects until, in the judgment of the City Manager, circumstances relating to the project make the
release or satisfaction appropriate or warranted.
This ordinance has been transmitted to the Agenda Coordinator for placement on the
October 23, 2003 City Commission Agenda.
