A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN OFF -SYSTEM
CONSTRUCTION AND MAINTENANCE AGREEMENT, IN SUBSTANTIALLY
THE ATTACHED FORM, WITH THE STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION ("FDOT"), FOR IMPROVEMENTS ON STATE ROAD 9 /
NORTHWEST 27 AVENUE FROM NORTHWEST 17 STREET TO
NORTHWEST 20 STREET, MIAMI, FLORIDA, FOR GENERAL ROADWAY
IMPROVEMENTS IN THIS CORRIDOR, INCLUDING IMPROVEMENTS ON
ROADS NOT ON THE STATE HIGHWAY SYSTEM.
WHEREAS, the Florida Department of Transportation ("FDOT") has developed design
plans Financial Management ("FM") Project No. FM 449366-1-52-01 for State Road ("SR") 9 /
Northwest 27 Avenue from Northwest 17 Street to Northwest 20 Street, for the milling and
resurfacing of the existing asphalt pavement, ADA improvements, installation of traffic signal
loops, installation of new roadway signage and pavement markings, and installation of new
pedestrian signals and detectors and new mast arms ("Project"); and
WHEREAS, FDOT intends to undertake and complete the Project, a portion of which
includes work on roads not on the State Highway System but City of Miami ("City") right-of-way,
specifically on Northwest 18th Terrace for +/-50-ft east of Northwest 27 Avenue, Northwest
South River Drive for +/-50-ft west of Northwest 27 Avenue, and Northwest 20th for +/-60-ft east
and for +/-60-ft west of Northwest 27 Avenue (for purposes of this agreement, the "Off -System
Project Limits") and
WHEREAS, the Project includes pavement restoration through milling and resurfacing of
the existing asphalt pavement, installation of new roadway signs and pavement markings, and
installation of signalization components at the intersection of Northwest 20 Street, including
traffic signal loops, removal of existing service disconnect, new conduits and new pullboxes
("Local Roadway Improvements") and all activities associated with, or arising out of the
construction of the Local Roadway Improvements; and
WHEREAS, the Off -System Construction and Maintenance Agreement ("Agreement"),
attached and incorporated as Exhibit "A," establishes the terms, conditions, and responsibilities
of FDOT and the City to accomplish the Project and Local Roadway Improvements on the City's
Streets; and
WHEREAS, the City agrees with the terms and conditions in the Agreement, in
substantially the attached form;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute the Agreement, in substantially
the attached form, with FDOT, for the Project within the Off -System Project Limits, which
includes improvements on roads not on the state highway system, and the Local Roadway
Improvements.
Section 3. This Resolution shall become effective immediately upon its adoption.
