A RESOLUTION, WITH ATTACHMENT, DESIGNATING A
BROWNFIELDS AREA IN THE CITY OF MIAMI, FLORIDA,
TO INCLUDE THE WYNWOOD BROWNFIELDS PILOT
PROJECT AND CERTAIN AREAS WITHIN OVERTOWN AND
ALLAPATTAH, FOR THE PURPOSE OF ENVIRONMENTAL
REMEDIATION, REHABILITATION AND ECONOMIC
DEVELOPMENT; FURTHER AUTHORIZING THE CITY
MANAGER TO NOTIFY THE FLORIDA DEPARTMENT OF
ENVIRONMENTAL PROTECTION OF SAID DESIGNATION..
WHEREAS, the State of Florida has provided in Ch. 97-277, Laws of Florida, codified as
Sections 376.77-376.84, Florida Statutes, for the designation by resolution of certain contiguous
areas consisting of one or more Brownfields sites as "Brownfields Areas", and for the
corresponding provision of environmental remediation, rehabilitation and economic development
for such areas; .and
WHEREAS, the City of Miami wishes to notify the Florida Department of Environmental
Protection of its decision to designate a Brownfields Area for remediation, rehabilitation and
economic development for the purposes set forth in Sections 376.77-376.84, Florida Statutes; and
WHEREAS, the City of Miami has previously designated a Brownfields Pilot Project
pursuant to the Environmental Protection Agency Brownfields initiative, the delineation of which
is to be included in the area proposed for designation under Sections 376.77-376,84; Florida
Statutes; and

WHEREAS, the City of Miami has additionally considered the criteria set forth in
Section 376.80(2)(a)I-4, Florida Statutes, namely: (i) whether the proposed Brownfields Area
warrants economic development and has a reasonable potential for such activities, (ii) whether the
Brownfields Area represents a reasonably focused approach and is not overly large in geographic
coverage, (iii) whether the Brownfields Area has potential to interest the private sector in
participating in remediation, rehabilitation and economic development, and (iv) whether the
Brownfields Area contains sites or parts of sites suitable for limited recreational open space,
cultural, or historical preservation purposes; and
WHEREAS, the designated Brownfields Area expands from the EPA -designated
Brownfields Pilot Project in Wynwood to include parts of Overtown and Allapattah; and
WHEREAS, the procedures set forth in Section 166,041, Florida Statutes, have been
followed, and proper notice has been provided in accordance with Sections 376.80(1) and
166.041(3)(c)2, Florida Statutes;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIA.lviI, FLORIDA:
Section 1. The recitals and findings set forth in the Preamble to this Resolution are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. The area depicted on "Exhibit A", attached hereto and incorporated herein
by reference, is hereby designated as a Brownfields Area for environmental remediation,
rehabilitation and economic development for the purposes as set forth in Sections 376.77-376.84,
Florida Statutes, under the following terms and conditions:
a. The City of Miami shall be the entity responsible for the Brownfields Area site
remediation and rehabilitation pursuant to Section 376.80(3), Florida Statutes.

However, such designation shall not render the City of Miami liable for costs of
site remediation, rehabilitation, and economic development or source removal, as
those terms are defined in Sections 376.77-376.84, Florida Statutes.
b. Such designation shall not render the City of Miami liable for costs of site
remediation, rehabilitation and economic development or source removal, as those
terms are defined in Section 376.79(14) and (15), Florida Statutes, or for any other
costs, above and beyond those costs attributable to the City of Miami's role as
administrator of a Brownfields Area site remediation and rehabilitation program
and as a property owner within the designated Brownfields Area.
Section 3. The City Manager is hereby authorized to notify the Florida Department of
Environmental Protection of the City of Miami's decision to designate a Brownfields Area for
remediation, rehabilitation and economic development for the purposes set forth in Sections
376.77-376.84, Florida Statutes.
Section 4. This Resolution shall become effective immediately upon its adoption.

LEGAL DESCRIPTION The City of Miami Brownfields area is defined by the following boundaries:
it is bound by the north with the East-West connection of the 1-195 Expressway; then goes in a westerly direction and
meets the centerline of the 1-95 Expressway interchange; then following a southerly direction on the north -south 1-95
this boundary line ends at NW 28th Street; then follows a westerly direction to NW 27th Avenue proceeding in a southerly
direction to NW 20th Street; then the boundary proceeds in an easterly direction to NW 12th Avenue and follows a southerly
direction to NW 14th Street; then easterly to meet Biscayne Boulevard; then to NE 15th Street. The geographical boundary

RECOMMiENDATI ON :
The administration recommends the City Commission approve
the . attached Resolution creating a State designated
Brownfields Area that includes Wynwood and parts of Overtown
and Allapattah.
BACKGROUND:
The 'Florida Legislature passed the "Brownfields
Redeve.?opment Act" in the 1997 legislative -session which
defines a Brownfields area as a contiguous area of one or
more brownfields sites, some of which may be contaminated,_
and which has been designated by a local government.
Further, Section 376.80(1) Florida Statutes states that a
local government with jurisdiction must notify the
department of its decision to designate a brownfields area
for the rehabilitation purposes as ss.376.77-376.84. The
notification must include a resolution.
The designation of this Brownfields area is 'intended to
accomplish the following:
• Designate an expanded version of the Federal Brownfields
Pilot Area as the State Brownfields Area.
▪ Provide a concentrated area for the assessment and
rernediation of contaminated sites.
• Provide an area which will be eligible for Federal, State
and Local redevelopment .incentives to stimulate.
redevelopment of contaminated sites.

WHEREAS, pursuant to Resolution No. 98.2422, adopted March
10, /.998, the City Commission designated a brownfields area for
remediation ind rehabilitation whtth included Wynwoad, and

WHEREAS, aftor • further analyses, the Empowerment' Zone.and
two adjuvant areas were identified for inclusion within the
bro -nfields area; and
TqriBREAS, the City wishes to expand the boundaries of the
original brownfielda area to include the above cites and to
notify the Florida Department of Environmental Protection of
such; and
WNEREA.S., the City of Miami has additionally considered tha

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH
ATTACHMENT(S), APPROVING THE EXPANSION OF THE BOUNDARIES OF THE
CITY OF MIAMI ("CITY") DESIGNATED BROWNFIELDS AREAS TO INCLUDE
THE ENTERPRISE ZONE AS ILLUSTRATED AND DESCRIBED IN "EXHIBITS A
AND 8," ATTACHED AND INCORPORATED, IN ACCORDANCE WITH CHAPTER
376.80, FLORIDA STATUTES, WHICH WILL FACILITATE THE ASSESSMENT,
REHABILITATION AND REDEVELOPMENT OF PROPERTIES WITHIN THE
BROWNFIELDS AREA THAT HAVE BEEN DETERMINED TO HAVE A CRITICAL
NEED FOR REDEVELOPMENT; AUTHORIZING THE CITY MANAGER TO NOTIFY
THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION AND THE
MIAMI-DADE COUNTY DEPARTMENT OF ENVIRONMENTAL RESOURCES
MANAGEMENT OF SAID EXPANSION; AND AUTHORIZING AND DIRECTING THE
CITY MANAGER TO UNDERTAKE ANY NECESSARY RELATED PROCEDURES,
NOTICES, AND REQUIREMENTS AND TO NEGOTIATE AND TO EXECUTE ANY
NECESSARY DOCUMENTS AND AGREEMENTS FOR SAID DESIGNATION, FOR
SAID PURPOSES.
WHEREAS, the State of Florida has provided in Chapter 376.77 - 376.84, Florida Statutes
(Brownfields Redevelopment Act), for the designation, by resolution, of contiguous areas consisting of
one or more Brownfields Sites to be known as Brownfields Areas, and for the provision of
environmental assessment, remediation, rehabilitation and economic development of such areas; and
WHEREAS, Brownfields Sites are defined as real property where expansion or redevelopment is
complicated by actual or perceived environmental contamination; and
WHEREAS, pursuant to Resolution 98-242, adopted March 10, 1998, and Resolution 99-197,
adopted March 23, 1999, the City Commission previously designated certain areas within the City of
Miami ("City") to be Brownfields Areas, which were determined to have redevelopment potential that
might be limited by actual or perceived environmental issues; and
WHEREAS, after further analyses, other areas within the City were identified that have a critical
need .for rehabilitation and redevelopment, and meet the following designation criteria, in accordance
with Chapter 376.80(2)(a), Florida Statutes (Brownfield Program Administration Process): (1) the
proposed Brownfields Area warrants economic development and has a reasonable potential for such
activities; (2) the proposed Brownfields Area represents a reasonably focused approach and is not
overly large in geographic coverage; (3) the proposed Brownfields Area has potential to interest the
private sector in participating in rehabilitation; and (4) the proposed Brownfields Area contains sites or
parts of sites suitable for limited recreational open space, cultural, or historical preservation purposes;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by

reference and incorporated as if fully set forth in this Section.
Section 2. The expansion of the boundaries of the City designated Brownfields Areas to include
the Enterprise Zone as illustrated and described in "Exhibits A and B," attached and incorporated, in
accordance with Chapter 376.80, Florida Statues (Brownfields Program Administration Process), which
will facilitate the assessment, rehabilitation and redevelopment of properties within the Brownfields
area that have been determined to have a critical need for redevelopment, is approved.
Section 3. The City Manager is authorized to notify the Florida Department of Environmental
Protection and the Miami -Dade County Department of Environmental Resources Management of said
expansion.
Section 4. The City Manager is authorized and directed to undertake any necessary related
procedures, notices and requirements and to negotiate and to execute any necessary documents and
agreements for said designation, for said purposes.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1 }

{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become

Statutes, for Brownfield program administration processes, the City Manager is authorized{1} to notify
the Florida Department of Environmental Protection and the Miami -Dade County Department of
Environmental Resources Management of the City's decision to expand the City of Miami Brownfield
Areas to include the Enterprise Zone as illustrated and described in "Exhibit A," attached and
incorporated.
Section 4. The City Manager is authorized{1} to undertake any other necessary related
procedures, notices, and requirements for said designation, for said purposes.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may
be imposed by the City Attorney, including but not limited to those prescribed by
applicable City Charter and Code provisions.

2. The Office of Tourism, Trade, and Economic Development,("OTTED"), offers
eligible businesses Brownfield Redevelopment Bonus Refunds in the form of up
to S2,500 tax refunds "for each new Florida job created in a brownfield area.
8. Florida's Brownfield Property Ownership Clearance Assistance provides low -
interest loans from OTTED are available to assist in the purchase of outstanding,
unresolved contractor liens, tax certificates, or other liens or claims on brownfield
sites.
9. Florida's State Sales Tax Refund for Building Materials Used in Redevelopment
Projects in brownfields areas.
10, The Brownfields Assistance Revolving Loan Fund program, administered by
Miami -Dade County OCED, provides low -interest rate loans for Phase I and
Phase II Environmental Site Assessment activities.
11. South Florida Regional Planning Council's Revolving Loan Fund to assist with
brownfield remediation.
12. Liability protection for the person responsible for brownfields cleanup, lenders,
state agencies or local government from the State of Florida.
13. Application of risk -based based corrective action principles, which allows for
cleanup decisions base on actual risk to the public and the environment.

November 13, 2013, as more particularly described in Exhibit "1", attached and incorporated; and
WHEREAS, certain contaminants in excess of the Residential Cleanup Target Levels were
discovered in the soil at 3400 Grand Avenue, Miami, Florida (Billy Rolle Park), on or about December
23, 2013, as more particularly described in Exhibit "1", attached and incorporated; and
WHEREAS, certain contaminants in excess of the Residential Cleanup Target Levels were
discovered in the soil at 3349 Pan American Drive, Miami, Florida (Site of Future Regatta Park), on or
about April 26, 2013, as more particularly described in Exhibit "1", attached and incorporated; and
WHEREAS, certain contaminants in excess of the Residential Cleanup Target Levels were
discovered in the soil at 4355 Southwest 42nd Avenue, Miami, Florida (Merrie Christmas Park), on or
about September 20, 2013, as more particularly described in Exhibit "1"; attached and incorporated;
and
WHEREAS, certain contaminants in excess of the Residential Cleanup Target Levels were
discovered in the soil at 140-142 Southwest 11th Street, Miami, Florida (Southside Park), on or about
December 23, 2013, as more particularly described in Exhibit "1", attached and incorporated; and
WHEREAS, the City has already undertaken assessment and remediation of the Properties in
accordance with local and State law; and
WHEREAS, pursuant to Resolution No. 98-242, adopted March 10, 1998; Resolution No.
99-197, adopted March 23, 1999; Resolution No. 05-0117, adopted February 24; 2005; and Resolution
No. 06-0561, adopted September 28, 2006, the City Commission designated certain areas within the

City to be Brownfield Areas, which contain vacant, blighted, or underused property that might be
limited by'actual or perceived environmental contamination, as more particularly described in Exhibit
"2", attached and incorporated; and
WHEREAS, the Properties are located outside of the current City Brownfield Area previously
designated, shown on the map marked Exhibit "3", attached and incorporated; and
WHEREAS, the City desires to designate the Properties as Brownfield sites; and
WHEREAS, the City agrees to rehabilitate and remediate the Properties; and
WHEREAS, the rehabilitation and redevelopment of the Properties will result in the creation of
recreational areas and parks; and
WHEREAS, the Property use is consistent with the local comprehensive plan and are
permissible uses under the applicable local land development regulations; and
WHEREAS, the Properties are designated as City parks and will remain as City parks; and
WHEREAS, the City has sufficient financial resources to implement and complete the
rehabilitation agreement and restoration of the Properties; and
WHEREAS, the City has considered the following criteria set forth in Florida Statutes Section
376.80(2)(a) in designating the Properties as Brownfields, as more particularly described in Exhibit "4",
attached and incorporated: (1) whether the Brownfield site warrants economic development and has a
reasonable potential for such activities, (2) whether the proposed area to be designated represents a
reasonably focused approach and is not overly large in geographic coverage, (3) whether the area has
potential to interest the private sector in participating in rehabilitation, and (4) whether the area
contains sites or parts of sites suitable for limited recreational open space, conservation areas, or
parks; and
WHEREAS, pursuant to Florida Statute 376.80(1)(c)(1) of the Florida Brownfields
Redevelopment Act, the City shall notify the Florida Department of Environmental Protection and the
Miami -Dade Department of Regulatory and Economic Resources for amendments to the existing City
Designated Brownfield Area; and
WHEREAS, the City Commission has determined that the Properties have met the criteria to
be designated as Brownfield sites;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as fully set forth in this Section.
Section 2. The City Commission designates the Properties as Brownfield sites within the City,
for the purpose of environmental rehabilitation and pursuant to Florida Statutes Section 376.78, et.
seq.
Section 3. In accordance with the Brownfields Redevelopment Act, Section 376.80(1), Florida
Statutes, for Brownfield program administration processes, the City Manager is directed to notify the

Florida Department of Environmental Protection and the Miami -Dade Department of Regulatory and
Economic Resources of the designation of the Properties as Brownfield sites, and to undertake any

Section 4. The map of designated Brownfield sites and areas shall be updated to include the
Properties.
Section 5. Simultaneous to the designation, the City will continue remediation of City parks
affected by contamination, enter into a Brownfields Site Rehabilitation Agreement for each park, and
apply for Voluntary Cleanup Tax Credits upon obtaining a Site Rehabilitation Completion Order.
Section 6. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor.{1}
