Miami Court, Miami, Florida on q • Zq • IA . City Clerk 5-17-14 Saturday Visited 1915 N.W. Miami Court, House Nightclub Grand Opening for family and friends. While outside photographing the event, I was invited into the club by one of the owners, Maddie Cartagena. 5-24-14 Saturday 1:52 a.m. Visited 1915 N.W. Miami Court and I spoke to Maddie Cartagena, Managing Partner, and complained that the music was too loud. 5-29-14 Thursday 2:00 p.m. Visited Miami Police Department located at 400 N.W. 2nd Avenue and a loud music complaint was made to Commander Farmer and the Neighborhood Resource Officer Moyse. Both Commander Farmer and Officer Moyse advised me to call the police department instead of walking over to the establishment. I was informed that the police would take care of the loud music complaint. 5-31-14 Saturday 2:00 a.m. Telephoned loud music complaint to the City of Miami Police Department (See Exhibit A attached certified incident search/report). 6-23-14 Monday 10:00 a.m. Visited Jessica Capo, Code Compliance Director, and I filed the loud music complaint along with petition of fifty five signatures. 7-1-14 Tuesday 3:00 p.m. Visited James McQueen, Chief of Staff Commissioner Hardeman, District 5, to request for assistance and relief in this matter. 7-6-14 Sunday 1:07 a.m. Photograph of Lewd and Indecent exposure of sexual organs by one of the staff persons at 1915 N.W. Miami Court (See Exhibit B). 7-12-14 Saturday 3:06 a.m. Telephoned loud music complaint to the City of Miami Police Department. 7-19-14 Saturday 6:15 p.m. Met the police Commander Farmer at the Overtown Music Festival on NW 3rd Avenue and NW 10th Street. During that time I again complained about 1915 N.W. Miami Court, hours of disturbance between 2:00 1 Noise Impact Complaints 1915 N.W. City Clerk a.m. until 5:00 a.m. Commander Farmer requested for a copy of the petition which I presented to Director Capo. 7-20-14 Sunday 5:10 a.m. Visited 1915 N.W. Miami Court, to observe the building in noncompliance of the exception condition granted namely, a hard closure of 5:00 a.m. (See Periodic Observations ). The onsite off duty police officer Guzman, allowed me to take photographs. 7-24-14 Thursday emailed police Commander Farmer a copy of the loud music complaint. The City of Miami Administration and City Officials were sent carbon copies. 7- 25-14 Friday response from the office of the City Manager with findings of "Noise Detail" conducted at 1915 N.W. Miami Court, the House Night Club on Friday, July 11, 2014. 7-27-14 Sunday 3:28 a.m. A loud music complaint telephoned to the City of Miami Police Department. 8-9-14 Saturday 2:25 a.m. Telephoned a loud music complaint to the City of Miami Police Department. 2:48 a.m. contacted via telephone by Office Adams and he stated, "There is nothing that I can do". The reason given was because the club had a current certificate of use and occupational license to operate. I requested that the officer ask the owner to lower the music volume. Note: The volume of the music notably increased until after 5:10 a.m. 8-16-14 Saturday 3:58 a.m. — 4: 03 a.m. Visited and talked to off duty Officer Guzman, serving as security for 1915 N.W. Miami Court, about the loud music, and he stated that he understood what I was saying but, "There is nothing that I can do. I work for them after hours. They pay me to work for them." 8-16-14 Saturday 5:08 a.m. - 5:23 a.m. Visited 1915 N.W. Miami Court, House Nightclub to document noncompliance of the hard 5:00 a.m. closure. Observations made of patrons and the public inside as well as leaving out of the Noise Impact Complaints 1915 N.W. I informed Maddie Cartagena about the loud music which is vibrating and disturbing us in our neighborhood, and in our homes. Note this is the second complaint to the ownership concerning the loud music at 1915 N.W. Miami Court (See 5-24-14). 8-29-14 Friday met with City Manager Mr. Alfonso and Code Compliance Director Jessica Capo to discuss nuisance complaint at 1915 N.W. Miami Court. Ms. Capo briefed the City Manager and me on her findings and course of action from the inspection conducted on the weekend of Saturday, August 23, 2014. According to Ms. Capo, the loud music was heard outside of the building. Furthermore, when the concern was mentioned to the off duty police, he replied that there nothing that he could do because the nightclub had a current certificate of use and occupational license to operate. As per Ms. Capo, she did not issue any notice of violation during this visit. The owner, Maddie Cartagena was instructed to provide a buffer between the front door and the DJ section. In closing, I presented the City Manager with a copy of the following items: (1) June 23, 2014 complaint petition with fifty five signatures (2) floor plan of the building at 1915 N.W. VICTIM STATES SHE WAS AT THE ABOVE LISTED LOCATION AND AS SHE WALKED TO THE RESTROOM SHE BUMPEp INTO THE ABOVE LISTED SUSPECT. SUSPECT BECAME UPSET AND SPILLED HER DRINK ONTO THE VICTIM. VICTIM STATES THE SUSPECT THAN STRUCK HER IN THE FACE AND WAS ATTACKED BY MULTIPLE INDIVIDUALS WHO WERE WITH THE SUSPECT. VICTIM SUFFERED ABRASIONS TO HER FACE AND STATES SHE BELIEVES THAT THE SUSPECT THREW A GLASS CUP AT HER FACE CAUSING THE ABRASIONS. VICTIM INJURIES WERE CONSISTENT WITH SCRATCH MARKS AND VICTIM STATED "I'M NOT SURE WHO SCRATCHED ME, IT HAPPENED SO FAST. " THE SUSPECT STATES SHE WAS BUMPED BY THE VICTIM AND SHE DID THROW HER DRINK AND PUSH THE VICTIM IN ORDER TO DEFEND HERSELF. City Clerk Dear Ms. Angel-Capo, On behalf of the residents in the Northeast Overtown area located along N.W. lst Avenue and N.W. lst Court at N.W. 19th-17th Street, we would like to report the disturbance and nuisance of the loud music playing in our neighborhood by the following establishment, House Night Club located at 1915 N.W. Miami Court, Miami, FL 33136. The music is so loud that it reverberates into our homes and intensely disturbs our sleep. We are requesting your advisement and assistance in implementing the City of Miami Noise Ordinance Section 36-4: Music from Bars, Clubs and Other Business Establishments The playing of music between the hours of 11:00 p.m. and 7:00 a.m. the following day is unlawful if it is audible from outside of the building so as to disturb the comfort of persons in any dwelling or residence. This prohibition does not apply to activities and events held in or upon city -owned facility or other city -owned property. Please find listed below the fifty five signatures of the residents that are impacted by the loud music. We would like the loud music stopped or brought into compliance with the City Ordinance.
