The Resolution has been modified to reflect the correct title and body of said Resolution, as seen below: A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO APPLY FOR A SECTION 108 LOAN IN THE APPROXIMATE AMOUNT OF SIX MILLION DOLLARS ($6,000,000.00), WITH AN OWNER CONTINGENCY FEE OF SIX HUNDRED THOUSAND DOLLARS ($600,000.00), FOR A TOTAL NOT TO EXCEED AMOUNT OF SIX MILLION SIX HUNDRED THOUSAND DOLLARS ($6,600,00.00), FOR THE CONSTRUCTION OF A NEW COMMUNITY CENTER AND THE ENVIRONMENTAL REMEDIATION OF DOUGLAS PARK LOCATED AT 2795 SOUTHWEST 37 AVENUE, MIAMI, FLORIDA; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 14-00789 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO APPLY FOR A SECTION 108 LOAN IN THE AMOUNT OF SIX MILLION DOLLARS ($6,000,000.00), FOR THE CONSTRUCTION OF A NEW COMMUNITY CENTER AND THE ENVIRONMENTAL REMEDIATION OF DOUGLAS PARK LOCATED AT 2795 SOUTHWEST 37 AVENUE, MIAMI, FLORIDA; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, the City of Miami ("City") is addressing contamination discovered at the Coconut Grove Fire Rescue Training Center under the regulatory supervision of the Miami -Dade Department of Regulatory and Economic Resources ("RER"); and WHEREAS, the City's investigation of its parks revealed that Douglas Park, located at 2795 Southwest 37 Avenue, Miami, Florida, was contaminated; and WHEREAS, the remediation at Douglas Park requires the demolition of the current community center and construction of a new community center; and WHEREAS, the estimated cost to remediate Douglas Park is approximately three million five hundred thousand dollars ($3,500,000.00), and demolition and construction of a new community center is approximately two million five hundred thousand dollars ($2,500,000.00), for a total cost of six million dollars ($6,000,000.00); and WHEREAS, the City Administration has made the necessary plans to allocate funds for all other parks, but not the substantially larger amount of funds needed to thoroughly remediate Douglas Park; and WHEREAS, the City Administration recommends the City Manager to apply for a Section 108 loan in the amount of six million dollars ($6,000,000.00), for the environmental remediation and construction of a new community center at Douglas Park; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized{1} to apply for a Section 108 loan in the amount of six million dollars ($6,000,000.00), for the construction of a new community center and the environmental remediation of Douglas Park located at 2795 Southwest 37 Avenue, Miami, Florida. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPRO ED AS TO FORM AND CORRECTNESS: VICTdRIA MENDEZ CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
