HomeMy WebLinkAboutMemo - Office of the City Attorney FRCITY OF MIAMI OFFICE OF THE CITY ATTORNEY MEMORANDUM TO: The Honorable M or and Members of the City Commission FROM: Victoria Mendez City Attorney DATE: June 30, 2014 RE: Proposed Ordinance for City Commission Meeting — July 10, 2014 Amending Chapter 11,5 of the City Code regarding the nomination of members to the Civilian Investigative Panel File No, 14-00527 The attached proposed Ordinance for the July 10, 2014 City Commission meeting was drafted at your direction for the purposes of amending Section 11.5-28 of the City Code, entitled "Membership; nomination of members; terms of office and vacancies; appointment of the CIP nominating committee," to amend the membership, appointment process, and terms of office for the Civilian Investigative Panel ("CIP") members, Currently, the CIP is exclusively responsible for nominating members for service on the CIP. All vacancies in the membership of the CIP are filled by the City Commission, by majority vote, exclusively from names submitted to it by the. CIP. The City Commission can only appoint from the list of nominees or reject the nominees; it cannot nominate members of its own accord. For various reasons, the CIP has been either unwilling or unable to timely nominate persons to fill vacancies on the CIP. As a consequence, the CIP is facing a dire situation where it will soon be unable to hold meetings because of a lack of membership. If this situation is not remedied, it is likely that the CIP will not be able to meet for the purposes of nominating new members to fill the necessary vacancies and as a consequence, the CIP will cease to be functional. This amendment removes the CIP' s exclusive authority to nominate members and places that authority into the hands of the City Commissioners and the Mayor. This amendment will place the CIP on the same footing as almost every other board or panel of the City whose members are nominated by the City Commission. • It is respectfully requested that the proposed ordinance be adopted.
