Avila Child Development Center, LLC's ("El Avila" or the "Applicant") appeal of the action taken by the Planning, Zoning and Appeals Board (the "PZAB") in connection with its denial of an exception pursuant to Article 4, Table 3, of Zoning Ordinance 13114 (a/k/a/ "Miami 21", hereinafter referred to as the "Code") to allow operation of a pre-sehool on the Property, situated within in the T3-R, Sub -Urban Transect Zone. Through this appeal, El Avila seeks the City Commission's approval of its application (the "Application") for an exception so that it may change the current use of the Property from a daycare facility, which has been operating, on the Property for the past seventeen (17) years, to pre-school use, to expand the existing operation to the abutting property located at 2475 SW 22" Avenue (referred to as "Building A" in the Application) and increase the number of students from twenty (20) to forty nine (49) (the "Exception"). SUThi7MAR.Y OF APPEAL hi Avila'rr'Application for an Exception should he approved because: • The Application Wily complies with all of the criteria set forth in the Code and in Florida Statutes governing the operation of pre-school facilities; • The Planning Director (the "Director") and Zoning Administrator (the "Administrator") both recommended that the PZAB approve the Application; • The 'PZAB`s denial of the Application was legally deficient and constitutes error: and • The PZAB hearing denied the Applicant due process, and was presided over by a hoard meniber who has an admitted conflict, and failed to recuse herself. www.ecclegal.com 501 Brickell Key Drive Suite 300 Miami, Florida 33131 II. THE APPLICATION IS CODE COMPLIANT AND COMPLIES WITH FLORIDA STATUTES Purusant to Florida Statute §402.305(6)(b), a pre-school requires 35 square feet of building space and 45 square feet of outdoor space per child. The proposed Exception is compliant because 49 children would require a total of 1,715 square feet of indoor space and 2,205 of outdoor space, and the Property is comprised of 3,060 of indoor space and 11,185 of outdoor space. IIh THE DIRECTOR AND THE ADMINISTRATOR RECOMMENDED APPROVAL The Director and Administrator recommended approval based upon the fact that the proposed Exception meets the criteria of the Code and the Florida Statutes governing the operation of pre-school facilities. Please see that certain Analysis for Exception, Findings and Comments attached hereto as Exhibit "A" (the "Analysis and Recommendation Memo"), which was read into the record at each of the March 18, 2014 and April 30, 2014 PZAB public hearings. IV. THE PZAB'S DENIAL WAS LEGALLY DEFICIENT The PZAB is required to grant an approval of an exception in the event an application complies with all applicable regulations pursuant to Section 7.1.2.6 (c)(2) of the Code, which provides that "[a]pprovals shall be granted when the application complies with all applicable regulations." The Analysis and Recommendation Memo specifically states that the proposed use is in compliance with all relevant sections of the Code (see Exhibit "A"). The PZAB is also required to issue written findings in connection with its decision to deny an application for an exception, which written findings are required to set forth legal authority for a denial pursuant to Code Section 7.1.2,6 (c)(2). As of the date of this Appeal, the Applicant has not received the PZAB's written findings or any written communication indicating legal authority for the denial of the Exception as required by the Code. In fact, City staff indicated that as of May 12, 2014, the written decision had not even been drafted, barring Applicant of the benefit of a review of such written decision. To that end, the Applicant hereby preserves its right to amend this Appeal upon review of the written decision of the PZAB. The decisions of various board members were based on legally insufficient bases. By way of example, one board member cited space per child as a basis for voting to deny the Exception, a criteria that is governed by the Florida Statutes and met by the proposed Exception (see Analysis and Recommendation Memo). T 305.722.2002 F 305.722.2001 V. THE CHAIR FAILED TO RECUSE HERSELF Section 7.1.1.4(d)(6) of the Code requires that "... any member of the Planning, Zoning and Appeals Board ... [whom] shall find that his private or personal interests are involved in the matter coming before the board, he shall, prior to the opening of the hearing on the matter, disqualify himself from all participation of whatsoever nature in the cause," At the conclusion of the two (2) hour public hearing on Applicant's petition on April 30, 2014 and before making her motion for denial of the Exception, Chairperson Janice 1. Tarbert disclosed that she "has a personal interest in this matter because [she] lives in the neighborhood." CONCLUSION For all of the foregoing reasons, the Appellant, through its undersigned attorneys, hereby appeal the April 30, 2014 decision of the PZAB. Furthermore the Appellants reserve the right to supplement this appeal letter with briefs, petitions, exhibits, testimony, memoranda or other support materials or evidence prior to the City Commission's consideration of this appeal.
