It has been brought to our attention that as of today, no MOT plan was provided to the City. Also, your permit application is for closures starting on March 27th, yet, we have reports of sidewalk closures today. The extended closure dates might require the payment of fees to the Public Works Department. Furthermore, it appears some of your closures fail to meet minimum safety standards (see attached pictures) and appear to be in violation of the Federal American with Disabilities Act (ADA). Please provide the City of Miami with a maintenance of traffic plan as required on section 6 of your special events application and provide pedestrian access in accordance with local, state and Federal requirements. Please call me if you have any questions or comments. The City of Miami Public Works Department wants to work with you in having this issues resolved. I submitted the MOT a few months ago to the city as it is required for me to get a signature from the city manager before I present the MOT to FDOT. So I incorrectly assumed that the city has a copy. Nontheless I am attaching this again as well as the FDOT penult and the Kimley Hom paperwork. We will move the fence line back to accommodate for ADA access - these were most likely moved temporarily to move a piece of machinery and was not put back. We are trying to stay on top of this and will continue to do so. As far as the medians go - I was led to believe since I am leasing these lots that includes the sidewalks. I have no other choose but to put the fence where it is currently located because the pavers are very uneven and there is a row of trees that makes it even more difficult to deploy these items.
