A RESOLUTION OF THE MIAMI CITY COMMISSION PROHIBITING THE
BAYFRONT PARK MANAGEMENT TRUST FROM HOLDING THE ULTRA MUSIC
FESTIVAL IN THE FUTURE DUE TO A BREACH OF CONTRACT BY THE ULTRA
MUSIC FESTIVAL; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS
RESOLUTION TO THE BAYFRONT PARK MANAGEMENT TRUST.
WHEREAS, the Ultra Music Festival ("Festival") was held March 28, 2014 to March 30, 2014 at
Bayfront Park; and
WHEREAS, the Festival resulted in 84 documented arrests and 153 documented calls for
Fire -Rescue service during the weekend; and
WHEREAS, most notably, all the incidents occurring during the. Festival, put an unparalleled
strain on the City of Miami's ("City's") public safety services; and
WHEREAS, this year, Festival attendees without tickets, through no fault of the City, stormed
the perimeter fence to gain illegal access to the Festival, without regard for human life or safety, and
the ensuing mob trampled a security guard working at the event; and
WHEREAS, the security guard's condition was so severe that she was sent to Jackson
Memorial Hospital with serious life -threatening injuries; and
WHEREAS, prior to the incident, City officials ordered the organizers of the Festival to reinforce
and increase fencing at the location where the stampede occurred, in an effort to ensure safety at the
event; and
WHEREAS, the organizers of the Festival did not provide proper fencing and comply with this
order, resulting in the abovementioned incident that left the security guard in critical condition, and
contributed to the overall chaotic nature the event brings to Downtown Miami; and
WHEREAS, this is but one incident of many, including rampant drug use, graffiti, and other
crimes that continue to have a deleterious effect on the City, and in particular, the Downtown area; and
WHEREAS, this year, a 21 year old died in a parked car after attending the Festival, allegedly
due to having drank something laced with chemicals; and
WHEREAS, last year, a 20 year old allegedly died from a drug overdose at the Festival; and
WHEREAS, last year a Festival attendee fell into a coma and nearly died allegedly after
drinking water that another Festival attendee had laced with anti -freeze; and
WHEREAS, pursuant to Section 38-104 of the Code of the City of Miami, Florida, as amended
("City Code"), the Bayfront Park Management Trust has "the power to do all things necessary to direct,

manage and maintain Bayfront Park..."; and
WHEREAS, Section 38-104 of the City Code limits that power by providing that Bayfront Park
Management Trust's broad powers are, "subject at all times to city commission approval and any
existing contractual obligations"; and
WHEREAS, it is in the best interest of the health, safety and welfare of the residents of the City to
discontinue this event; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as fully set forth in this Section.
Section 2. The Miami City Commission hereby prohibits the Bayfront Park Management Trust
from holding the Ultra Music Festival in the future due to a breach of contract by the Ultra Music
Festival.
Section 3. The City Clerk is hereby directed to transmit a copy of this Resolution to the Bayfront
Park Management Trust.
Section 4. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor.{1}

Footnotes:
(1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
