Request: Exception pursuant to Article 4, Table 3 of Miami 21 Zoning Code and
Chapter 4 of the City Code, Sections 4-7 (b) and 4-11 (g), to allow a non -Consumption
On Premises (C.O.P) package liquor store within 500 feet of an existing package liquor
store.

Current Zoning Designation: T6-24-0 (Urban Core Transect Zone - Open)
FINDINGS AND COMMENTS:
1. The use is compatible with the uses under the Transect Zone Urban Core.
2. Pursuant to Article 4, Table 4 commercial use requires a minimum of 3 parking
spaces per 1,000 square feet, which requires approximately forty-six (46) parking
spaces for 15,355 square feet of commercial area. The applicant will provide forty-
nine (49) parking spaces that will exceed the minimum required parking spaces of
forty-six (46).
3. Pursuant to Article 4, Table 12 and Article 5, Section 5.6.5, the architectural
) facade along the Principal frontage, SW 7 Street, requires modification to the
architectural treatment that does not impede "eyes -on -street" and to ensure no
vehicular Tight spillage into the right-of-way from the vehicular circulation ramp and
above ground parking area. The applicant shall provide additional details of the
proposed precast polished concrete band along the building for review and approval
by the Planning and Zoning Department prior to Building Permit.
4. Pursuant to Section 4-7 and Section 4-11 (g) (2) of the City Code, prior to the
issuance of any Building Permit, the applicant needs to provide a radius survey that
clearly shows no residentially zoned areas within 375 foot radius of the proposed
non-C.O.P package liquor store.
5. Submit a Landscape Plan that complies with the minimum requirements of Article
9 of the Miami 21 Code Landscape Requirements for review and approval by the
Planning and Zoning Department prior to Building Permit
Based on the above findings, the Planning and Zoning Department recommends
Approval of the application with the following condition(s) pursuant to comments 3, 4
and 5 above mentioned.

Dear Mr. Garcia,
The undersigned is the authorized legal representative for Brickell Commerce Plaza, Inc.
and 296 SW 7 Street Corp. the Owners of the subject properties requesting an Exception,
pursuant to Sections 4-7(b) and 4-11 (g) of the City's Code of Ordinances to allow a package
liquor store located closer than 500 feet of another package liquor store.
The proposed new liquor store will be part of a new 15,200 square foot Walgreens store
at 296 SW 7th Street. The new Walgreens will be a two story urban store with roof top parking.
The store's design features a modern, metal -clad facade. It is modern, pedestrian -friendly, urban
and distinctively innovative.
The liquor store will meet the needs of the growing residential population of the West
Brickell area. The liquor store portion of the store will consists of approximately 1,750 square
feet in area. As with all Walgreens liquor stores, the store will have a separate entrance form the
store/pharmacy.
This application requests an exception to permit the liquor store closer than 500 feet of
another liquor store at 720 SW 2"d Avenue, operating as the Brickell Station Liquor Center, in
the Chevron gas service station at SW 7th Street and SW 2"d Avenue. Please note that there are
no schools or churches within 1500 feet of the proposed liquor store.

Section 4-11(g) of the City Ordinances establishes the following criteria for modifying
the distance between non-C.O.P. package liquor stores (for consumption off -premises only).
The restrictions as to distance between non-C.O.P. package liquor stores (for
consumption off -premises only) may be modified by the zoning board. In making their decision,
the zoning board will specifically review and make findings based on the following criteria:
(1) Whether there is ample off-street parking on the same site as is the subject
establishment or whether there is adequate off-street parking off the site or whether there
is adequate parking in combination.
The proposed Walgreens store, including the liquor store, requires 47 parking spaces and
49 on -site parking spaces are provided. In addition, the new store will include 5 bicycle
racks.
(2) Whether there are residentially zoned areas within a 375-foot radius of the subject
site and how the subject site is screened in terms of noise, odor and light from these
residential areas.
There are no residentially zoned areas within a 375-foot radius of the store, however,
areas surrounding the store could be developed for medium and high density mixed
use residential developments. Walgreens liquor stores are impeccably clean, well -lit,
professionally managed and maintained.
(3) How, and to what extent, advertising signs on the establishment have been
satisfactorily minimized in size and reduced in lighting intensity.
The signage for the liquor store has been designed with the signage for the Walgreens
store. All signage will comply with the criteria and standards in Miami 21.
(4) How, and to what extent, the proposed establishment meets the standards in
section 1305, Zoning Ordinance No. 11000, which are not otherwise required to be
considered above
While the standards of Section 1305 of Ordinance 1100 are no longer in effect, the design
criteria of Miami 21 is a codification of the design criteria that Section 1305 of the
forming zoning ordinance aspired to promote. The design of the Walgreens store,
including the liquor store, is pedestrian friendly, minimizes vehicular drives, is designed
with the pedestrian perspective in the forefront, the building entrance is oriented to the

corner, the rooftop parking area is completely screened, and all service elements,
including the pharmacy drive through window and loading bays are located behind the
building.
Based on the foregoing, we respectfully request your favorable review and

responses to this application must be typed and signed in black ink. All pertinent and accurate
information/documentation; i.e., the plans, reports, exhibits, shall be presented at the time of filing, in
