Request: Exception pursuant to Article 4, Table 3 of Miami 21 Zoning Code and
Chapter 4 of the City Code, Sections 4-7 (b) and 4-11 (g), to allow a non -Consumption
On Premises (C.O.F) package liquor store within 500 feet of an existing package liquor
store.

Current Zoning Designation: T6-24-O (Urban Core Transect Zone - Open)
FINDINGS AND COMMENTS:
1, The use is compatible with the uses under the Transect Zone Urban Core.
2. Pursuant to Article 4. Table 4 commercial use requires a minimum of 3 parking
spaces per 1,000 square feet, which requires approximately forty-six (46) parking
spaces for 15,355 square feet of commercial area. The applicant will provide forty-
nine (49) parking spaces that will exceed the minimum required parking spaces of
forty-six (46).
3. Pursuant to Article 4, Table 12 and Article 5, Section 5.6.5, the architectural
facade along the Principal frontage, SW 7 Street, requires modification to the
architectural treatment that does not impede "eyes -on -street" and to ensure no
vehicular light spillage into the right-of-way from the vehicular circulation ramp and
above ground parking area. The applicant shall provide additional details of the
proposed precast polished concrete band along the building for review and approval
by the Planning and Zoning Department prior to Building Permit,
4. Pursuant to Section 4-7 and Section 4-11 (g) (2) of the City Code, prior to the
issuance of any Building Permit, the applicant needs to provide a radius survey that
clearly shows no residentially zoned areas within 375 foot radius of the proposed
non-C.O.P package liquor store.
5. Submit a Landscape Plan that complies with the minimum requirements of Article
9 of the Miami 21 Code Landscape Requirements for review and approval by the
Planning and Zoning Department prior to Building Permit
Based on the above findings, the Planning and Zoning Department recommends
Approval at the application with the following condition(s) pursuant to comments 3, 4
and 5 above mentioned.

A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD APPROVING
WITH CONDITIONS, WHICH FAILED, CONSTITUTING A DENIAL OF AN EXCEPTION AS
LISTED IN ARTICLE 4, SECTION 4-7(b) AND 4-11(g) OF THE CODE OF THE CITY OF
MIAMI, FLORIDA, TO ALLOW A PACKAGE LIQUOR STORE CLOSER THAN 500 FEET OF
ANOTHER PACKAGE LIQUOR STORE, FOR THE PROPERTIES LOCATED AT
APPROXIMATELY 250 AND 296 SOUTHWEST 7TH STREET, MIAMI, FLORIDA, LEGALLY
DESCRIBED IN ATTACHED "EXHIBIT A".
