HomeMy WebLinkAboutResolutionCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-00693 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER TO ENSURE THAT ALL PERMITS ISSUED PURSUANT TO THE PAYPHONE PILOT PROGRAM ESTABLISHED PURSUANT TO RESOLUTION NO. 01-49, ADOPTED MAY 10, 2001 HAVE EXPIRED; FURTHER DIRECTING THE CITY MANAGER TO CONFIRM THAT EVERY PAYPHONE ON CITY RIGHT OF WAY IS PROPERLY PERMITTED AND REQUIRING IMMEDIATE ENFORCEMENT OF THE PENALTIES IN CHAPTER 54, ARTICLE XI, USE OF THE PUBLIC RIGHTS OF WAY FOR INSTALLATION OF PAY TELEPHONES, OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED. WHEREAS, pursuant to Resolution No. 01-449, adopted May 10, 2001, the City Commission authorized a Payphone Pilot Program with First American Telecom, allowing for installation of payphone kiosks on the streets of the City of Miami ("City") for a limited period of time; and WHEREAS, the Payphone Pilot Program was to be temporary for a duration of one (1) year; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is directed to ensure that all permits issued pursuant to the Payphone Pilot Program established pursuant to Resolution No. 01-449, adopted May 10, 2001 have expired. Section 3. The City Manager is further directed to take all steps necessary to confirm that every payphone on City right of way is properly permitted and requiring immediate enforcement of the penalties in Chapter 54, Article XI, Use of the Public Rights of Way for Installation of Pay Telephones, of the Code of the City of Miami, Florida, as amended. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} APPROVED AS TO FORM AND CORRECTNESS: JULIE O.
