Brief Legislative History

How we arrived here
• 2000: Chapter 54, Sec. XI enacted, allowing
phones on the public right of way.
• 2001: Payphone pilot program launched w/
FAT for kiosks with advertisements, limited to
certain specific areas.
• 2002: Pilot program ends.
• 2009: State statute passed allowing
advertisements on properly permitted
payphones.
Data: Definitions and Assumptions
• Phone types:
— ROW Phones: Found on the public right of way
— Non -ROW Phones: Within private establishments
• Timeframe: 2007 — 2012; FAT phones only.
— Complete data available for 2008 — 2011, inclusive.
— 2007 data available for the first six (6) months
— 2012 data available for the first nine (9) months
• 2007 number doubled and 2012 number multiplied by 4/3.
— Accounts for possible seasonal fluctuations and is consistent with
full year's data from 2008 — 2011, inclusive.
ROW Phone Locations
• 163 phones on the ROW in the City (94 permitted by City
on City / County ROW, 69 permitted by FDOT on their
roads).
— 45 standard phones (no advertising)
— 118 kiosk phones (with advertising)

• Handles approximately 550,000 — 600,000
calls a year.
— Vast majority of which (96%+) do not come from
payphones.
— Of the 4% of payphone calls to the 911 system,
substantially all made from non -ROW phones

Recommendation
• The "public service" of these phones has diminished over
time as usage has decreased, both in terms of general
calls, and 911 calls (where arguably, there is a greater
public benefit).
• Direct the City Manager and City Attorney to amend Ch.
54 to prohibit issuance of new permits for payphones,
city-wide.
— Remove existing payphones upon expiration of current permit.
• Alternatively, amend Ch. 54 to prohibit
advertisements on phones.
— State statute permits, but does not require
advertisements on payphones.
