Danie, City Clerk City Commission Meeting Minutes December 13, 2012 Present: Commissioner Gort, Vice Chair Sarnoff, Commissioner Carollo, Chair Suarez and Commissioner Spence -Jones On the 13th day of December 2012, the City Commission of the City ofMiami, Florida, met at its regular meeting place in City Hall, 3500 Pan American Drive, Miami, Florida, in regular session. The Planning and Zoning Commission Meeting was called to order by Chair Suarez at 2:33 p.m., recessed at 2:36p.m., reconvened at 6:20 p.m., and adjourned at 6: 23 p.m. ALSO PRESENT: Julie O. Bru, City Attorney Johnny Martinez, P.E., City Manager Dwight S. Danie, City Clerk PLANNING AND ZONING ITEMS Chair Suarez: Madam City Attorney, can you read the procedures to be followed of the Planning & Zoning meeting. Maria J. Chiaro (Deputy City Attorney): P&Z (Planning & Zoning) items shall proceed according to Section 7.1.4 of the Miami 21 zoning code. Before any PZ item is heard, all those wishing to speak will be sworn by the City Clerk. Staff will briefly describe each item as it is to be heard. The members of the City Commission shall disclose any ex parte communications. The appellant or petitioner will then present the request and may waive the right to an evidentiary hearing. The order of presentation shall be as described in the City Code. Members of the public will be permitted to speak on certain items. The City ofMiami requires that anyone requesting action by the City Commissioners must disclose before the hearing anything provided to anyone for agreement to support or withhold objection to the requested action. Any documents offered to the City Commission that have not been provided seven days before the meeting as part of the agenda materials will be entered into the record at the City Commission's discretion. Chair Suarez: Thank you, Madam Attorney. I don't think we can do any business, so -- Dwight S. Danie (City Clerk): Would you like to do the oath? Is everybody here? Chair Suarez: Yeah. Let's go ahead and do that. Mr. Danie: Okay. Anybody who would be speaking on a P&Z item, please stand and raise your right hand, please. The City Clerk administered oath required under City Code Section 62-1 to those persons giving testimony on zoning issues. Mr. Danie: Thank you. Chair Suarez: Thank you, sir. We don't -- Do we have to close to go back to the regular agenda or would we --? We would have to? Mr. Danie: (UNINTET,TIGIBT,F) faster. Chair Suarez: It would be faster? Chair Suarez: But it would be faster to come back to it, you're saying? Mr. Danie: No. It will close faster this time than it took last time. Chair Suarez: Okay, well, we don't have a quorum, so we can't start until we have a quorum, so I guess we'll remain in recess -- Mr. Danie: You want to recess? Chair Suarez: -- until such time as we have a quorum. Mr. Danie: Okay. And we'll be going into the regular meeting then, or are we going into the P&Z? Vice Chair Sarnoff What's left on the regular -- what's left in the regular meeting? Chair Suarez: There's not much left. There's almost -- there's only discussion items, and there's four REs (Resolutions). Vice Chair Sarnoff What four REs are left? Chair Suarez: Electing and appointing a Clerk, the Munilla Construction bid, accepting the processing recycling materials -- Vice Chair Sarnoff I see it, I see it. Chair Suarez: -- and opposing/supporting the closing of Biscayne Boulevard. Those are the four, and then everything else is a discussion item. Vice Chair Sarnoff We got a time certain on 32, right, 4: 30? Chair Suarez: You know, I don't have my time certains -- Vice Chair Sarnoff I think it's 4: 30. Chair Suarez: -- in front of me. Yeah, there's several time certains. I don't have them in front of me, but I'll go get them. Yeah, exactly. I think that one's 4: 30. Mr. Danie: So this is -- are we in recess? So we're in recess? Chair Suarez: Yeah. Mr. Danie: Okay. Chair Suarez: I mean, we don't have a quorum so. [Later..] Chair Suarez: Okay. Commissioner Carollo: Mr. Chairman. Chair Suarez: Yes, go ahead, sir. I know you're anxious to make a motion. City ofMiami Page 3 Printed on 1/7/2013 City Commission Meeting Minutes December 13, 2012 Commissioner Carollo: I make a motion to defer the rest of the -- or all the PZ (Planning & Zoning) items that have not been deferred already to the January 10 meeting. Chair Suarez: Is there a second? Commissioner Carollo: That's in District 3, andl need more time to review with Francisco, and that is in District 3. Francisco Garcia (Director, Planning): IfI may, sir. It may be -- it may do well to go item by item for a moment, begging your patience and indulgence, just so that we can dispense with the P&Z agenda clearly for everyone's reference. If Commissioner Carollo's referring to item PZ. 1, and if the Commission is ready to entertain some of these items, I'm ready to proceed. Chair Suarez: I would, but I don't think he wants to. That's the thing. Commissioner Carollo: My motion was to defer the PZ items -- Chair Suarez: We're losing quorum. Commissioner Carollo: -- until January 10 meeting. We don't even have a full Commission. I mean, you know -- Mr. Garcia: Fair enough. So can -- what I would ask then is that we take the items in the PZ agenda -- and none have been acted upon yet, none have been. So if we can take them one by one, some may be deferred to, say the loth, others to the 24th, so we can at least dispense with all of them appropriately. Chair Suarez: I'm willing to do that. Are you willing to do that? Mr. Garcia: In fact, I'll make it simpler. I'll make it simpler. Chair Suarez: Let's defer them all to the 10th; how about that? And then we can defer on the 10th to the next P&Z item [sic]. Mr. Garcia: What would request -- andl think it may make perfect sense because I'll remind you that in the month of January, the 24th is the P&Z agenda meeting and the 10th is the regular meeting. So if we can ask for a continuance ofPZ.1 to the loth and the remainder to the 24th, I think that may be the best outcome. Chair Suarez: I would say PZ.5, 6, and 14 should also be on the loth 'cause they've been deferred multiple times. Actually, PZ. 5 and 6 have been deferred multiple times. Unidentified Speaker: How about 15? Chair Suarez: 15 as well. I don't -- it was going to be deferred, right? Mr. Garcia: Fair enough, sir.
