HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 12-00848 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN INDEMNIFICATION AND HOLD HARMLESS AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, INDEMNIFYING MIAMI-DADE COUNTY ("COUNTY") FOR LOSSES AND DAMAGES FROM THE CITY OF MIAMI'S USE OF COUNTY -OWNED SCOOTERS WHILE PERFORMING OFF -DUTY FIRE -RESCUE SERVICES AT THE MARLINS BALLPARK. WHEREAS, the City of Miami ("City") Department of Fire -Rescue utilizes Emergency Medial Services scooters at the Marlins Ballpark while performing off -duty Fire -Rescue services; and WHEREAS, the scooters are property of Miami -Dade County ("County"); and WHEREAS, the County is requesting that the City complete an Indemnification and Hold Harmless Agreement ("Agreement") for the use of the County property and equipment; and WHEREAS,the Agreement will indemnify and hold harmless the County in the event a claim shall arise while the City utilizes the equipment; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an Agreement, in substantially the attached form, indemnifying the County for losses and damages from the City's use of County -owned scooters while performing off -duty Fire -Rescue services at the Marlins Ballpark. Section 2. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNES JULIE O. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
