Background Information:
Chapter 39 of the City Code establishes a procedure including a lottery to authorize a limited number of
franchises to be granted for street vending at specific locations within the public right-of-way within the
Miami Arena and Biscayne Boulevard Special Vending Districts. The Miami Arena District is bounded by
NW/NE 5th Street, NW 3`d Avenue, NE 2nd Avenue and NW/NE l Oth Street. The Biscayne Boulevard
District is bounded by Biscayne Boulevard, NE 11 th Street, NE 1st Avenue and NE 5th Street. Since the
adoption of the Special Vending Districts, significant demolition and redevelopment has occurred in the
Miami Arena and Biscayne Boulevard Districts that impacts the availability of locations to safely and
responsibly conduct street vending within the right-of-way. The Miami Arena has since been demolished
and no longer exists and several residential complexes have been constructed. The City maintained
sidewalks in the Biscayne Boulevard District are not sufficiently wide enough to accommodate the carts,
coolers and chairs necessary to the vending operation and to safely accommodate pedestrians visiting the
District. Further, the adoption of the temporary use permit for vacant, privately owned lots provides
adequate opportunity for itinerant vending outside of the public right-of-way.
There are no street vendors currently franchised to operate in the Miami Arena District. There are five (5)
street vendors currently operating in the Biscayne Boulevard District under franchise periods that all expire
on September 30, 2011. The attached Ordinance will prohibit street vending within the right-of-way within
the Miami Arena District upon the effective date of the Ordinance. The effective date for the prohibition of
street vending within the right-of-way within the Biscayne Boulevard District will be at the expiration of the
current franchise period, September 30, 2011.
