RE: Proposed Resolution — City Commission Agenda — February 23,
2012 Waiving the conflict of interest provisions contained in Section
2-614 of the code of the City of Miami, Florida, as amended, to
enable Miguel de la 0 to enter into an agreement to transact business
with and for the City of Miami.

Miguel de la 0 is a lawyer with substantial experience litigating attorney's fees in South
Florida. He has agreed to serve as an expert witness on fees in the case of The Painter v. City of
Miami, Circuit Court Case Number 05-12967 CA (24). Miguel de la 0 is also a member of the
City of Miami Civil Service Board.
Section 2-612 of the Code of the City of Miami, Florida, as amended, prohibits a member
of any board of the City of Miami ("City") from entering into contract or transacting any
business with the City or an agency acting on behalf of the City.
Waiving the limitation on transacting business with the City or agency acting on behalf of
the City and allowing Mr. de la 0 to act as an expert witness for the City, will assure the City the
benefit of Mr. de la O's unique expertise and availability to provide substantial expert analysis
and testimony on an expedited basis and is in the interests of the City.
