HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-01073 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT, PURSUANT TO A WARRANTY DEED, THE DONATION OF A PARCEL OF LAND LOCATED AT 721 NORTHEAST 85 STREET, MIAMI, FLORIDA, FOLIO NUMBER 01-3207-003-0630 ("PROPERTY"), FROM PSR, LLC., A FLORIDA LIMITED LIABILITY CORPORATION TO THE CITY OF MIAMI; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE WARRANTY DEED, IN SUBSTANTIALLY THE ATTACHED FORM, ALONG WITH ANY OTHER NECESSARY DOCUMENTS, TO. ACCOMPLISH THE ACQUISITION OF THE PROPERTY. WHEREAS, the President of PSR, LLC., Mr. Paul A. Scolieri-Rothberg ("Grantor"), owns a parcel of land located at 721 Northeast 85 Street, Miami, Florida, Folio Number 01-3207-003-0630 ("Property"); and WHEREAS, the Grantor desires to donate the Property to the City of Miami ("Grantee"); and WHEREAS, the Grantor will convey the Property to the Grantee by Warranty Deed, in a form acceptable to the City Attorney; and WHEREAS, the City has done due diligence, verifying there are no liens owed on the Property, no prior year taxes due and no apparent contamination issues; and WHEREAS, according to the Property Appraiser's Office, the total assessed value of the Property for 2011 is Twenty -One Thousand Eight Hundred and Twenty Five Dollars ($21,825); and WHEREAS, the City of Miami Parks Department recognizes the need for parks in the Biscayne Heights community and recommends the acceptance of the donation; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to accept, pursuant to a Warranty Deed, the donation of the Property from PSR, LLC, as Grantor, to the City of Miami, as Grantee. Section 3. The City Manager is further authorized{1} to execute the Warranty Deed, in substantially the attached form, and any other necessary documents, to accomplish the acquisition of the Property. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JULIE 0. BRU CITY ATTORNEY . Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
