A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING THE RESPONSES RECEIVED JUNE 30, 2011, PURSUANT TO
INVITATION FOR QUOTATION NO. 273256, ISSUED IN ACCORDANCE WITH
SECTION 2.29 OF REQUEST FOR QUALIFICATIONS NO. 222246, AS
AUTHORIZED PURSUANT TO RESOLUTION NO. 10-0419, ADOPTED
SEPTEMBER 23, 2010, FROM THE VARIOUS ADDITIONAL QUALIFIED
PROPOSERS, AS IDENTIFIED ON "EXHIBITA", ATTACHED AND
INCORPORATED, TO PROVIDE COMMERCIAL SOLID WASTE HAULING
SERVICES WITHIN THE CITY OF MIAMI; AUTHORIZING THE CITY MANAGER TO
EXECUTE NON-EXCLUSIVE COMMERCIAL SOLID WASTE FRANCHISE
AGREEMENTS, IN SUBSTANTIALLY THE ATTACHED FORM, WITH SAID
PROPOSERS, FOR AN INITIAL CONTRACT PERIOD OF FIVE (5) YEARS, WITH
OPTIONS TO RENEW FOR THREE (3) ADDITIONAL ONE (1) YEAR PERIODS.
WHEREAS, on September 23, 2010, the Commission adopted Resolution No. 10-0419, accepting
the responses from twenty-two (22) qualified proposers and further authorized the City Manager to
execute Non -Exclusive Commercial Solid Waste Franchise Agreements with all proposers; and
WHEREAS, Resolution No. 10-0419 further authorized the City of Miami ("City") to add additional
qualified proposers in the event any of the franchisees were cancelled, terminated, or the franchisees
otherwise ceased to do business or provide adequate service within the City; and
WHEREAS, effective March 1, 2011 and May 24, 2011, four (4) out of the twenty-two (22) initially
qualified proposers were deemed in default of their contractual obligation and the City, through action
taken by the Purchasing Department, voided the acceptance of the proposer's response; and
WHEREAS, as authorized pursuant to Resolution No. 10-0419, and pursuant to Section 2.29 of
Request for Qualifications ("RFQ") No. 222246, on May 27, 2011, the Purchasing Department issued
on-line Invitation for Quotation ("IFQ") No. 273256 in order to qualify additional proposers to provide
Commercial Solid Waste Hauling Services; and
WHEREAS, a total of three (3) responsive and responsible proposers responded to IFQ No.
273256 and are therefore being recommended as additional qualified proposers for the provision of
Commercial Solid Waste Hauling Services;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The responses received June 30, 2011, pursuant to IFQ No. 273256, issued in

accordance with Section 2.29 of RFQ No. 222246, as authorized pursuant to Resolution No. 10-0419,
adopted September 23, 2010, from the various additional qualified proposers, as identified on "Exhibit
A", attached and incorporated, to provide Commercial Solid Waste Hauling Services within the City of
Miami, are accepted.
Section 3. The City Manager is authorized {1} to execute Non -Exclusive Commercial Solid Waste
Franchise Agreements, in substantially the attached form, with said proposers, for an initial contract
period of five (5) years, with options to renew for three (3) additional one (1) year periods.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}

{1} The herein authorization is further subject to compliance with all requirements that may be impo
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Co
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar d<
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effec
immediately upon override of the veto by the City Commission.
