RE: -Request -for Qualifications(RFQ)-222246-Commercial-Solid Waste hauling Services --
Dear Mr. Vazquez:
On Monday, December 27, 2010, the City of Miami Purchasing Department emailed to your attention a letter
indicating that we had yet to receive the documents requested via the Notice of Award emailed to your attention on
Monday, October 4, 2010. You were provided with a deadline to submit the required documentation by no later than
5:00 PM on Friday, January 7, 2011. Unfortunately, the required documentation was not received by the stated
deadline.
With the above facts being presented, CNC Management Group, Inc., is hereby deemed "in default of its contractual
obligation" and therefore "the City, through action taken by the Purchasing Department" has voided "acceptance of
the Bidder's/Proposer's Response" in accordance with Section 1.10, Award of Contract, subsection C), of the
Request for Qualifications solicitation document, copied below.
'The award of this contract may be preconditioned on the subsequent submission of other documents as
specified in the Special Conditions or Technical Specifications. Bidder/Proposer shall be in default of its
contractual obligation if such documents are not submitted in a timely manner and in the form required by
Me City. Where Bidder/Proposer is in default of these contractual requirements, the City, through action
taken by the Purchasing Department, will void its acceptance of the Bidders/Proposers Response and may
accept the Response from the next lowest responsive, responsible Bidder or Proposal most advantageous
to the City or re -solicit the City's requirements. The City, at its sole discretion, may seek monetary restitution
from Bidder/Proposer and its bid/proposal bond or guaranty, if applicable, as a result of damages or
increased costs sustained as a result of the Bidders/Proposers default."
In the near future, should CNC Management Group, Inc., respond to a solicitation (IFQ, IFS, RFQ, RFP, RFLI) issued
by the City of Miami, pursuant to Section 1.3, Acceptance/Rejection, The City also reserves the right to reject the
response of any bidder/proposer who has previously failed to property perform under the terms and conditions of a
contract, to deliver on time contracts of a similar nature, and who is not in a position to perform the .requirements
defined in this formal solicitation."

Dear Mr. Marzano:

With the above facts being presented, Royal Flush, LLC., is hereby deemed 'in default of its contractual obligation"

Bidder's/Proposer's Response" in accordance with Section 1.10, Award of Contract, subsection C), of the Request for
Qualifications solicitation document, copied below.
"The award of this contract may be preconditioned on the subsequent submission of other documents as

In the near future, should Royal Flush, LLC., respond to a solicitation (IFQ, IFB, RFQ, RFP, RFLI) issued by the City
of Miami, pursuant to Section 1.3, Acceptance/Rejection, "The City also reserves the right to reject the response of
any bidder/proposer who has previously failed to properly perform under the terms and conditions of a contract, to
deliver on time contracts of a similar nature, and who is not in a position to perform the requirements defined in this
formal solicitation."

Dear Mr. Guanche:
On Wednesday, March 9, 2011, the City of Miami Purchasing Department emailed to your attention a letter indicating
that we had yet to receive the "Performance Bond", originally requested via the Notice of Award emailed to your
attention on Monday, October 4, 2010 and a follow up letter dated December 23, 2010. Via the March 9, 2011 letter
you were provided with a deadline to submit the required documentation by no later than 5:00 PM on Friday, March -
18, 2011. Unfortunately, the required documentation was not received by the stated deadline.
With the above facts being presented, Greener Waste Services, Inc., is hereby deemed 'in default of its contractual
obligation" and therefore "the City, through action taken by the Purchasing Department' has voided "acceptance of
the Bidder's/Proposer's Response" in accordance with Section 1.10, Award of Contract, subsection C), of the
Request for Qualifications solicitation document, copied below.
