HomeMy WebLinkAboutR-11-0517City of Miami Legislation Resolution: R-11-0517 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-01086 Final Action Date: 12/15/2011 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT A TOTAL AMOUNT OF NOT TO EXCEED $634,007 IN THE FORM OF A REIMBURSEMENT GRANT ("GRANT") FROM THE CHILDREN'S TRUST ("TRUST") TO THE CITY OF MIAMI'S ("CITY'S") DEPARTMENT OF GRANTS ADMINISTRATION'S EDUCATION INITIATIVES ("DEPARTMENT"), FOR THE TRUANCY REDUCTION PLAN PROGRAM ("PROGRAM"), AND AUTHORIZING THE CITY'S IN -KIND SERVICES MATCH IN THE TOTAL AMOUNT OF NOT TO EXCEED $5,400 TO FUND THE PROGRAM ADMINISTERED BY THE DEPARTMENT AT VARIOUS ELEMENTARY, MIDDLE, AND HIGH SCHOOLS WITHIN THE CITY; ESTABLISHING A NEW SPECIAL REVENUE PROJECT ENTITLED: "THE CHILDREN'S TRUST GRANT FOR EDUCATION INITIATIVES 2011-2012 TRUANCY REDUCTION PLAN PROGRAM", TO ACCEPT THE GRANT, APPROPRIATING THE GRANT FUNDING IN THE AMOUNT NOT TO EXCEED $634,007, WITH IN -KIND SERVICES TO BE APPROPRIATED BY THE CITY VALUED AT AN AMOUNT NOT TO EXCEED $5,400; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND TO EXECUTE A CONTRACT WITH THE CHILDREN'S TRUST AND TO NEGOTIATE AND EXECUTE ALL OTHER NECESSARY AMENDMENTS, EXTENSIONS, AND MODIFICATIONS, AFTER CONSULTATION WITH THE CITY ATTORNEY, TO IMPLEMENT THE ACCEPTANCE OF AND COMPLIANCE WITH THE GRANT AWARD FOR SAID PURPOSES, FOR THE PERIOD COMMENCING NOVEMBER 1, 2011 THROUGH JULY 31, 2012, WITH THE OPTIONS TO RENEW FOR UP TO TWO (2) ADDITIONAL SIMILAR PERIODS AT THE SAME NOT -TO -EXCEED AMOUNTS UNDER THE SAME TERMS AND CONDITIONS FOR THE PROGRAM, SUBJECT TO BUDGETARY APPROVAL AT TIME OF NEED. WHEREAS, the City of Miami's ("City") Department of Grants Administration Education Initiatives (the "Department") has been awarded one (1) reimbursement grant from The Children's Trust (the "Trust") for the City's Truancy Reduction Plan Program (the "Program"), in an amount not to exceed $634,007 (the "Grant'), commencing November 1, 2011 through July 31, 2012, and the City and the Trust are negotiating the form of contract, ("The Children's Trust Contract") for said purposes at various elementary, middle, and high schools within the City; and WHEREAS, the Program is comprised of a cooperative effort between the City, Miami -Dade County Public Schools, the 11th Judicial Circuit Court, and several community -based organizations for its successful implementation; and WHEREAS, the goals of the Program are to connect the home, school, and community to ensure that children acquire the necessary skills for success in their adult life, so that they are able to compete in a global economy; and WHEREAS, the City must execute one (1) award package including the new form of The City of Miami Page 1 of 3 File Id: 11-01086 (Version: 2) Printed On: 10/24/2017 File Number: 11-01086 Enactment Number: R-11-051 7 Children's Trust Contract, to accept the Grant Award and in order to enter into related professional service agreements with not -for -profit service providers and the related interlocal agreements with Miami -Dade County Public Schools and the 11th Judicial Circuit Court in order to comply with the Trust requirements; and WHEREAS, the City Manager and the Department are requesting for the City Commission to authorize the City Manager to negotiate and to execute and, if necessary, to amend, extend, or modify, after consultation with the City Attorney, The Children's Trust Contract, for the period from November 1, 2011 through July 31, 2012, with the options to renew for up to two (2) additional similar periods for the same not to exceed amounts, under the same terms and conditions subject to budgetary approval at time of need; and WHEREAS, under the Grant, the City is required to provide an in -kind match in the amount of not to exceed $5,400 corresponding to the services provided to the Program by the City's Education Initiatives Coordinator within her regular working hours; and WHEREAS, the City Manager and the Department are requesting the appropriation of said Grant funding and the City's in -kind match for the Program for the initial Fiscal Year 2011-2012, with future Fiscal Year funding subject to consultation with the City Attorney and budgetary approval at time of need; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized to accept a total amount of not to exceed $634, 007 in the form of a reimbursement grant ("Grant") from The Children's Trust ("Trust") to the City of Miami's ("City's") Department of Grants Administration's Education Initiatives ("Department') for the Truancy Reduction Plan Program ("Program") and the City's in -kind services match in the total amount of not to exceed $5,400, is authorized to fund the Program administered by the Department at various elementary, middle, and high schools within the City. Section 3. The following new Special Revenues Project is established and resources are appropriated as described below: FUND TITLE: The Children's Trust Grant for Education Initiatives 2011-2012 Truancy Reduction Plan Program RESOURCES: The Children's Trust City The City of Miami's In -Kind Match APPROPRIATIONS: $634,007 $5,400 $639,407 Section 4. The City Manager is further authorized, after consultation with the City Attorney, {1} to negotiate and to execute a contract with the Trust and to negotiate and execute all other necessary amendments, extensions, and modifications, after consultation with the City Attorney, to implement the acceptance of and compliance with the Grant award for said purposes, for the period City of Miami Page 2 of 3 File Id: 11-01086 (Version: 2) Printed On: 10/24/2017 File Number: 11-01086 Enactment Number: R-11-051 7 commencing November 1, 2011 through July 31, 2012, with the options to renew for up to two (2) additional similar periods at the same not -to -exceed amounts under the same terms and conditions for the Program, subject to budgetary approval at time of need. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
