The subject proposal seeks an Exception to allow a Supper Club within a District 2 (D2) Industrial transect zone,
pursuant to Article 4, Table 3, Miami 21 Code and to all regulations and applicable criteria, as required.
Application requests:
To allow the operation of Supper Club within a District 2 (D2) Industrial Transect Zone
The subject property is located within the Winwood/Edgewater NET area and consists of one parcel comprising of
.33 acres located in the southeast corner of the block bound to the north by NE 25th Street, to the east by the
Florida East Coast Railway, to the south by NE 24th Street, and to the west by North Miami Avenue, as described
in Exhibit "A" (Complete legal description in on file with the Hearing Boards Section),
Review and analysis of the proposed application finds that:
Pursuant to Miami 21 Code as amended, the Zoning Ordinance of the City of Miami Florida, the
subject proposal to allow a supper club for Automatic Slim's Club at approximately 55 N.E. 24th Street
Miami, Florida, has been submitted and reviewed to allow an application for Exception permit, subject
to all applicable criteria;
EXCEPTION permit, as identified, ARTICLE 4, TABLE 3, and CITY CODE, Chapter 4, to allow a
Supper Club in Transect Zone D-2 subject to all the applicable criteria
The following findings have been made:
® On March 24, 2003 a supper club was approved at the subject property under Special Exception
Resolution No. 2003-0702. The approval included also a variance request for 74 parking spaces.
® On October 20, 2008 a Special Exception requesting a change of operator was considered by the.
Zoning Board and it was deferred, and no further action was taken until now.
• On September 30, 2011 an Exception permit was submitted requesting, under Miami 21 Article 4,
Table 3, and City Code, Chapter 4, to allow a Supper Club in Transect Zone D-2 subject to all the
applicable criteria for at.
• The Automatic Slim's Club (supper club) is proposed to operate in an existing one story building
located approximately 55 N.E. 24th Street and comprised of approximately 14,630 square feet.
The subject property has no parking spaces
The proposed adaptive re -use of the existing building will be split in three (3) phases and the
applicant is proposing to provide off -site parking as follow:

It is found that upon compliance with the conditions set forth below, this project will not have any
adverse impacts on the surrounding area.
Based on these findings, the Planning Department is recommending approval of the
application as presented with the following conditions:
1. Approval of this exception shall run with this operator only; any changes to a different operator
shall require a separate Exception permit.
2. The applicant shall provide proof of the lease and notify the City of Miami immediately if the
required lease or agreement is terminated.
3. Prior to the issuance of a building permit the applicant shall submit for review and approval to the
Planning and Zoning Director, the phasing time -table including the proposed areas for the required
parking spaces, and color elevations including facades improvements program and outside
lighting.

Pursuant to Article 4, Table 12 of the Miami 21 Code, the Zoning Ordinance of the City
of Miami, the specific site plan and aspects of the PROJECT have been found by the
City Commission (based upon facts and reports prepared or submitted by staff or others)
to adhere to the following Design Review Criteria subject to the any applicable
conditions in the Development Order herein:
DESIGN REVIEW CRITERIA
I) Site and Urban Planning: Applicability Compliance

Dear Mr. Rodriguez:
This law firm represents Rosenthal, LLC ("Applicant"), and Slim's
Universal Holding Company, LLC (the "Operator"), in connection with the
above referenced property, located at 55 NE 24th Street ("Property"). This letter
shall serve as the supplemental letter of intent with respect to the application for
an exception in connection with the establishment of Automatic Slims on
Property.
In response to the Planning Department's request, please be advised of the
following additional facts concerning the operation of the proposed supperclub
on the property:
Occupancy. The maximum occupancy is approximately 280
persons.
2) Operation Plan. The Club will operate seven (7) clays a week.
There will initially be employees including bartenders, a cook, and
security personnel. The goal of the business is to provide a
neighborhood serving drinking establishment that is characteristic
of the Wynwood Arts District.

3) Traffic. The property is located on a dead-end street in an entirely
industrial area along Miami Avenue. The roadway impacts
associated with patrons arriving by car will be minimal as there is
no traffic congestion at any time along in the immediate area.
4) Noise. The applicant will not be generating sound that will be
appreciable from a residential area since the club will be located
within an entirely enclosed building and the nearest residential
area is located more than 200 feet from the property.
5) Human Security Detail. Automatic Slim's will being employing its
own security guards/bouncers as needed, and as reasonably
determined to be needed depending upon how busy the
establishment is on any given evening. It is the general policy to
have both one man, and one woman, each of which operates as a
host at the front door. Typically the security guard/bouncer-is an
individual who mans the emergency door, and who also serves as a
bouncer if, as and when needed within the operation. Typically,_
various roving managers, door men and women and the security
details throughout the establishment will have constant
communication links to one another via radio frequency devices
attached to ear sets each will be wearing. This will ensure a
constant communications at all access points and elsewhere within
the establishment in order to be alerted to any emergency
situations.
Video Surveillance. In addition to the onsite security personnel, the
establishment will be fitted with state of- the art video surveillance
apparatus through the interior and exterior of the establishment.
These video devices will run on a 24 hour seven day basis, and will
be looped to both closed-circuit monitors within the building
management office, as well as, video recording/ storage devices
enabling playback at any time.
Proximity to Residential. The property is not located within two
hundred feet (200') of a residential property.
8) Parking. The Applicant intends to lease the abutting property to
provide all of the required parking spaces for each phase of the
project. Although the parking provided will be technically off -site,

the parking will be just steps away from the proposed
entertairunent establishment. The parking area is indicated on the
plan.
9) Sanitation. Sanitation will be provided by a private hauler on an
as -needed basis. At a minimum, we anticipate daily garbage pick-
ups.
Based on the above described operation plan, the supperclub will be
compatible • with the surrounding area. Should .you have any questions

'Pursuant:to Ordinance, Miam 21, the Zoning Ordinance of the City of Miami Florida, the subject
proposal fo s55 N.E. 24THSTREET , MIAMI, FLORIDA, has been submitted and reviewed to allow
UPPER CLUB appl afion for EXCEPTION Permit with CITY COMMISSION APPROVAL, subject

The existing building is located at 55 N.E. 24th Street and is a one story structure comprised of
approximately 14,630 square feet. The property has no parking spaces and is proposing to provide
off -site parking.
The proposed adaptive re -use of the existing building will be split in three (3) phases.
The First phase, will be changed to SUPER CLUB use from warehouse/commercial use for a total of
approximately 5,532 square feet and a minimum of 17 off -site parking.
In the Second phase, an additional 4,122 square feet will be changed to SUPER CLUB use from
warehouse/commercial use for a total of approximately 9,654 square feet, increasing the required
number of parking spaces by an additional 13 off -site parking spaces for a total of 30 off -site parking.
In the Third phase, an additional 4,976 square feet will be changed to SUPER CLUB use from
warehouse/commercial use for a total of approximately 14,630 square feet, increasing the required
number of off -site parking spaces by an additional 15 off -site parking spaces for a total of 45 off -site
parking.
EXCEPTION PERMIT, as identified in MIAMI 21, ARTICLE 4, TABLE 3, and CITY CODE, Chapter
4, as permitted by Exception in specific Transect Zone D-2, to allow a SUPPER CLUB in
TRANSECT ZONE D-2 subject to all the applicable criteria.
This EXCEPTION PERMIT encompasses the following WAIVER permits and request:
WAIVER, as per Article 7, Section, 7.1.2.5.a(11), to provide the required parking within one
thousand (1,000) feet of the site that it serves (Article 4, Table 4).
Approval of the Building Permit application under this Exception Permit will require applicant to submit
to the Office of Zoning for approval, detailed plans for the following Temporary Permits:
Temporary Permit, as per City Code Chapter 62, Section 62-529.6, to allow construction trailer(s);
Temporary Permit, as per City Code Chapter 62, Section 62-529.6, to allow temporary
development and construction signs;
REQUEST, for applicable EXCEPTION PERMIT and CITY COMMISSION, that the following
conditions be required at the time of issuance of Shell Permit instead of at issuance of Any Building
