City of Miami Legislation Resolution City Hall. 3500 Pan American Drive Miami, FL 33133 www.mlamlgov.com File Number: 09-01240 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO CONVEY, WITH TITLE REVERTER PROVISIONS, THE CITY OF MIAMI OWNED PROPERTY LOCATED AT 1302 NORTHWEST 54TH STREET, MIAMI, FLORIDA, LEGALLY DESCRIBED IN EXHIBIT "A", ATTACHED AND INCORPORATED, TO CURLEY'S HOUSE OF STYLE, INC., FOR THE HOPE FOOD BANK PROGRAM AND OTHER COMMUNITY SUPPORTIVE SERVICES THAT BENEFIT LOW TO MODERATE INCOME INDIVIDUALS AND FAMILIES, WITH CONDITIONS AS STATED HEREIN; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A PURCHASE AND SALE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, AND ALL OTHER NECESSARY DOCUMENTS FOR SAID PURPOSE. u) WHEREAS, on November 7, 1997, Prestige Enterprise, Inc. and Emma Lee Martin and Miami Capital Development, Inc, executed loan documents in the amount of $300,000 of Community Development Block Grant ("CDBG") funds ("Loan"); and WHEREAS, in 2001 the Department of Community Development took over the collection activities of all the Miami Capital Development, Inc's loans; and EREAS, on January 25;•2002, the City of Miami ("City") filed a Notice of Lis Pendens seeking to foreclose on the property located at 1302 Northwest 54th Street, Miami, Florida ("Property"), as a result of the default of the Loan; and WHEREAS, on July 21, 2009, the City obtained the Certificate of Title for the Property; and O4 WHEREAS, as of October 1, 2009, real estate property taxes in the amount of $40,511.85 and water and sewer services lien in the amount of $493.58 are outstanding and past due; and WHEREAS, on October 8, 2009, Curley's House of Style, Inc. ("Curley's") provided a letter of interest for the use of the Property for the Hope Food Bank Program and other community supportive programs that benefit low to moderate income individuals and families; and WHEREAS, under Title 24 Code of Federal Regulations Section 84.83(c)(2), the conveyance of the Property, which was obtained pursuant to a CDBG allocation, to Curley's will be contingent upon the United States Housing and Urban Development's ("HUD") approval; and WHEREAS, the Administration recommends that the conveyance of the Property be subject to the following restrictions: (i) the Purchaser agrees to pay at closing certain existing Water and Sewer Liens in the amount of $493.58 and outstanding real estate property taxes in the amount of $40,511.85 plus interest and other applicable fees at closing; (ii) the use of the Property shall be restricted for the provision of services through Curley's for the Hope Food Bank and other community co City of Miami - ©rio.i—SOb► iftat Grad m Page 1 of 2 ham �Q Printed On. 11/3/2009 File Number 09-01240 supportive services that serve low to moderate income individuals and families as described under Title 24 Code of Federal Regulations Section 570.208(a)(2)(i); (iii) any mortgages obtained by the Purchaser on the Property will be subject to approval by the City's Department of Community Development; and (iv) the Deed from the City to Curley's will be restricted indefinitely; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section, Section 2. The City Manager is authorized {1} to convey, with title reverter provisions, the City -owned property located at 1302 Northwest 54th Street, Miami, Florida, legally described in Exhibit "A", attached and incorporated, to Curley's, for the Hope Food Bank Program and other community supportive services that benefit low to moderate income individuals and families, subject to the following conditions: (i) the Purchaser agrees to pay at closing certain existing Water and Sewer Liens in the amount of $493.58 and outstanding real estate property taxes in the amount of $40,511.85 plus interest and other applicable fees at closing; (ii) the use of the Property shall be restricted for the provision of services through Curley's for the Hope Food Bank and other community supportive services that serve low to moderate income individuals and families as described under Title 24 Code of Federal Regulations Section 570.208(a)(2)(i); (iii) any mortgages obtained by the Purchaser on the Property will be subject to approval by the City's Department of Community Development; and (iv) the - Deed from the City to Curley's will be restricted indefinitely.
