HomeMy WebLinkAboutCertified Official ResultsCERTIFICATION AND DECLARATION OF RESULTS OF THE CITY OF MIAMI GENERAL MUNICIPAL ELECTION HELD ON TUESDAY, NOVEMBER 1, 2011 STATE OF FLORIDA COUNTY OF MIAMI-DADE ) CITY OF MIAMI I, Priscilla A. Thompson, City Clerk of the City of Miami, Florida, and as the Canvassing Board for the City of Miami (hereinafter referred to as "Canvassing Board") do hereby certify that all necessary legal steps were taken in connection with the conduct of a City of Miami General Municipal Election held on Tuesday, November 1, 2011, including, though not limited to, the following Logic and Accuracy Tests. I. On Wednesday, October 19, 2011 (testing of equipment used on election day): A. Commencing at approximately 10:00 a.m. the Miami -Dade County Supervisor of Elections representative had the tabulating equipment tested to ascertain that the equipment would correctly count the precinct and absentee ballots cast for the candidates to be voted in the Miami General Municipal Election to be held on November 1, 2011. B. The Canvassing Board compared the test results with the predetermined totals for each candidate and pursuant to the requirements established in Section 101.5612, Florida Statutes, observed the performance and results of all required tests and verified the correctness of the programs and equipment, as well as any replacement of said materials required by said tests, subject to said tests. C. At the completion of the above test, the verified Logic and Accuracy reports and test materials were placed in a sealed container with Seal Number 51552, and steps have been taken to ensure the security of said materials prior to, during and subsequent to the election, except when said materials are properly in the possession of the Elections Department staff appointed to conduct the election. II. On Wednesday, October 26, 2011 through Monday, October 31, 2011 (testing of equipment used on election day and canvass of absentee ballots presumed valid): A. On Wednesday, October 26, 2011, the Miami -Dade County Supervisor of Elections set the time to begin the opening of the valid absentee ballots and 1 the duplication of ballots (as needed) at 10:00 a.m., and commencing at 1 p.m. on Monday, October 31, 2011, the Canvassing Board resumed opening of the absentee ballots. III. I further certify that all documents concerning the above Logic and Accuracy Tests showed the tabulating equipment to be functioning correctly and that said documents are presently in the possession of the Supervisor of Elections of Miami -Dade County, in containers which were sealed under seal number 51552 and signed off by the Supervisor of Elections and the City Clerk. IV. On Tuesday, November 1, 2011 (Election Day) A. At approximately 4:00 p.m., the Miami -Dade County Supervisor of Elections began the pre -count logic and accuracy test of the optical scan system used for paper ballots, located at the Elections Department at 2700 NW 87th Ave, to ascertain that the equipment had not been tampered with, and that it would correctly count the precinct and absentee ballot votes cast for all City of Miami candidates. B. At the completion of the precinct and absentee ballot count, the pre -election test of the automatic tabulating equipment was again tested at approximately 7:00 p.m., before the official count of ballots to ascertain that the equipment correctly counted the precinct and absentee votes cast for all City of Miami candidates. C. At the completion of the tabulation of election results, approximately 9:45 p.m., November 1, 2011, the Miami -Dade County Supervisor of Elections presented me with the certification of the un-official results of the election tabulations, Per Florida Statute 101.048(1) persons casting provisional ballots have the right to present written evidence supporting his or her eligibility to vote to the supervisor of elections by not later than 5 p.m. on the third day following the election. That deadline was Thursday, November 3, 2011. V. On Friday, November 4, 2011 (Canvassing of the Provisional Ballots) Beginning at 10:00 a.m., we canvassed and tabulated provisional ballots cast during Election Day, after which, we received the certified official results of the election tabulations. VI. I further certify and declare that: • in the race for Commission District 1, Wifredo "Willy" Gort received more than 50 percent plus one of all votes cast and is hereby declared to have been elected City of Miami District 1 Commissioner; • in the race for Commission District 2, Marc Sarnoff received more than 50 percent plus one of all votes cast and is hereby declared to have been elected City of Miami District 2 Commissioner; • in the race for Commission District 4, Francis Suarez ran unopposed. Pursuant to Florida Statutes 101.151(7), "...the names of unopposed candidates shall not appear on the general election ballot. Each unopposed candidate shall be deemed to have voted for himself or herself." Candidate Suarez is hereby declared to have been elected City of Miami District 4 Commissioner. 3 VIII. On Monday, November 7, 2011 (Post Election Audit) At approximately 10:30 a.m. the Miami -Dade County Supervisor of Elections conducted a post election manual audit at the Elections Department at 2700 NW 87th Ave according to Florida Division of Election Rule 1S-5.026. The audit entailed audit teams manually counting the ballots cast by absentee voting, early voting, and by Election Day voting, for a randomly selected precinct within a randomly selected race. At the completion of the audit on Monday, November 7, 2011, at approximately 11:00 a.m. we received the voting system post election audit report.
