City of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-01038 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION WAIVING, PURSUANT TO SECTION 62-521(B) (4) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, THE TEMPORARY EVENT TWO (2) EVENT LIMITATION PER PROPERTY TO ALLOW THE BOYS AND GIRLS CLUB OF MIAMI-DADE, INC. TO SELL FIREWORKS AT THE PROPERTY LOCATED AT 2805 SOUTHWEST 32ND AVENUE, MIAMI, FLORIDA, BEGINNING DECEMBER 27, 2011 AND ENDING DECEMBER 31, 2011. WHEREAS, pursuant to Section 62-521, of the Code of the City of Miami, Florida, as amended ("City Code"), Temporary Events are limited to no more than two (2) events per year per property; and WHEREAS, pursuant to Section 62-521 (b) (4) of the City Code, the number of events can be waived upon affirmative vote of the City Commission; and WHEREAS, the Boys and Girls Club of Miami -Dade, Inc. wish to sell fireworks at the property located at 2805 Southwest 32nd Avenue, Miami, Florida, beginning December 27, 2011 and ending December 31, 2011; and WHEREAS, the proposed temporary use at the above location for an extended period of time would be beneficial to the City of Miami's residents; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Pursuant to Section 62-521(b) (4), of the City Code, the temporary events amount (no more than two [2] events per year per property), for the sale of fireworks at the property located at 2805 Southwest 32nd Avenue, Miami, Florida, beginning December 27, 2011 and ending December 31, 2011, is hereby waived. Section 3.
