HomeMy WebLinkAboutMemo - Fire-Rescue Exam ContractCITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO: FROM: Johnny Martinez, P.E City Manager Officer of the City Manager Beverly Pruit Director Department of mployee Relations DATE : October 5, 2011 FILE : SUBJECT :Request to Waive Requirements for Competitive Sealed Bidding Fire -Rescue Exam Contract REFERENCES: ENCLOSURES: This is a request to waive competitive procurement, by a four -fifths (4/5ths) affirmative vote of the City of Miami ("City") Commission, for a vendor to provide legally defensible promotional examination services to develop, administer, score and report for one (1) promotional examination processes each for the classifications of Chief Fire Officer, Fire Captain, and Fire Lieutenant for the Department of Human Resources. It is requested that the City waive the requirements for competitive sealed bidding as this action is not practicable or advantageous to the City. In lieu of competitive sealed bidding, it is requested that the City execute an amendment to extend, for a period of six (6) months, the current Professional Services Agreement (PSA) for promotional examination processes in the Department of Fire -Rescue with the current provider, EB Jacobs, LLC for a maximum amount .of $380,972.18 — the amount included in the original PSA — approved via City Commission resolution number 06-0031. No additionalfunding will be added to the terms of the PSA. The City Department of Human Resources is required by Collective Bargaining and the Civil Service Rules to provide promotional examination processes for the Civil Service promotional classifications in the Department of Fire -Rescue. The City experienced delays in the execution of agreements due to the May 7, 2009 hiring and promotional freeze, and collective bargaining negotiations. In an effort to meet the timing requirements of the promotional examination needs for development, implementation and administration, scoring and reporting, the Department of Human Resources has determined that it is not practicable and advantageous to the City to adhere to competitive bidding and therefore waive competitive bidding .to provide consulting services for Chief Fire Officer, Fire Captain, and Fire Lieutenant examination processes to the City and has presented this determination to the City, Manager. Development of promotional examinations for the classifications of Chief Fire Officer, Fire Captain, and Fire Lieutenant are currently underway with the current vendor, EB Jacobs,LLC. To engage in competitive bidding to provide said services in lieu of a six (6) month extension will jeopardize examination materials developed to date. Competitive bidding at this juncture would likely result in cost overruns to the City in the event that already developed promotional examination materials would need to be redone. In addition, time delays would likely result in the establishment of Eligible Registers for the three (3) sworn, promotion classifications in the Department of Fire- Request to Waive Requirements for Competitive Sealed Bidding of Fire -Rescue Promotional Examinations Page 2 Rescue to allow for the solicitation of a new vendor as well as for negotiations and the finalization of a new contract. As a result, the City wishes to execute an amendment to the Professional Services Agreement with the current consulting firm, EB Jacobs, LLC, for a period of six (6) months, for promotional examination services for the classifications of Chief Fire Officer, Fire Captain, and Fire Lieutenant to include time period of February 27, 2012 to August 26, 2012.
