Thompson, C C City Clerk DATE : October 3, 2011 SUBJECT : Certification of the MiMo BIC's September 30, 2011 Petition Process REFERENCES: ENCLOSURES: Certification of BIC's Petition Process FILE : Enclosed is the official certification of the results of the MiMo Business Improvement Committee's (MiMo BIC) petition process to create the MiMo Business Improvement District (MiMo BID). On Thursday, June 23, 2011, the Commission passed Resolution 11-0270 establishing a special assessment district, to be known as the MiMo BID, and authorizing the levy and collection of a special assessment for a period of three (3) years, subject to the approval of a majority of the affected property owners. The MiMo BIC opted to obtain approval of the affected property owners through a petition process. Per agreement between the MiMo BIC, the Office of the City Attorney and the Office of the City Clerk (Clerk), this process included the filing of affidavits and petitions with the Clerk by 5:00 PM, Friday, September 30, 2011. The MiMo BIC mailed affected property owners within the MiMo area packets of information including: general information about business improvement districts and the MiMo area; the assessment roll; blank affidavits; and petitions and filing instructions. On Friday, September 30, 2011, at 5:00 PM, the agreed upon deadline for the Clerk to have received affidavits and petitions from owners of the seventy-three (73) affected properties of the proposed MiMo BID, a total of twenty-seven (27) affidavits had been filed with the Clerk. The Clerk also received seventeen (17) petition pages with a total of twenty-seven (27) signatures in support of the MiMo BID, plus five (5) affidavits from petition signers expressing their desire to remove their initial support. The number of valid petition signatures in favor of the MiMo BID filed, twenty-two (22), represents 30.14% of the affected properties within proposed special assessment district and therefore, do not represent a majority of the affected property owners stipulated by Resolution 11-0270. c : Johnny Martinez, City Manager Julie O.
