HomeMy WebLinkAboutR-11-0414City of Miami Legislation Resolution: R-11-0414 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00939 Final Action Date: 10/13/2011 A RESOLUTION OF THE MIAMI CITY COMMISSION, PURSUANT TO SECTION 62-521(B) (4) AND (5), OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, WAIVING THE TEMPORARY EVENT TWO (2) EVENT LIMITATION PER PROPERTY AND THE TWO (2) WEEK DURATION LIMITATION PER PERMIT, IN ORDER TO ALLOW FOR THE 8TH ANNUAL ST. STEPHEN'S EPISCOPAL CHURCH CHRISTMAS TREE SALE AT 2750 MCFARLANE ROAD, MIAMI, FLORIDA, STARTING ON NOVEMBER 14, 2011 AND ENDING ON DECEMBER 25, 2011. WHEREAS, St. Stephen's Episcopal Church wishes to host the 8th Annual St. Stephen's Episcopal Church Christmas Tree Sale, located at 2750 McFarlane Road, Miami, Florida, starting on November 14, 2011 and ending on December 25, 2011; and WHEREAS, pursuant to Section 62-521, of the Code of the City of Miami, Florida, as amended ("City Code"), Temporary Events are limited to no more than two (2) events per year per property for no longer than two (2) weeks each; and WHEREAS, pursuant to Section 62-521 (b) (4) and (5), of the City Code, the number and time limitations can be waived upon affirmative vote of the City Commission; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Pursuant to Section 62-521(b) (4) and (5), of the City Code, the temporary events amount and time limitations (no more than two [2] events per property for no longer than two [2] weeks per permit), for the 8th Annual St. Stephen's Episcopal Church Christmas Tree Sale, at 2750 McFarlane Road, Miami, Florida, starting on November 14, 2011 and ending on December 25, 2011, are hereby waived for said period and said permit. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
