A RESOLUTION OF THE MIAMI CITY COMMISSION RESCINDING THE AWARD
TO MCINTYRE MAINTENANCE, INC., PURSUANT TO INVITATION FOR BID NO.
247232; AWARDING THE BID TO BCLS LANDSCAPING, INC., THE NEXT
LOWEST RESPONSIVE AND RESPONSIBLE BIDDER, FOR GROUNDS
MAINTENANCE SERVICES CITYWIDE, FOR AN INITIAL CONTRACT PERIOD OF
TWO (2) YEARS, WITH THE OPTION TO RENEW FOR TWO (2) ADDITIONAL,
ONE (1) YEAR PERIODS; ALLOCATING FUNDS FROM THE VARIOUS SOURCES
OF FUNDS OF THE USER DEPARTMENT, SUBJECT TO THE AVAILABILITY OF
FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED.
WHEREAS, pursuant to Resolution No. 11-0106, adopted March 10, 2011, the City Commission
awarded a bid to McIntyre Maintenance, Inc., for grounds maintenance services Citywide, for an initial
contract period of two (2) years, with the option to renew for two (2) additional, one (1) year periods;
and
WHEREAS, McIntyre Maintenance, Inc. has failed to perform in accordance with the terms and
conditions, pursuant to Sections 1.27 and 2.31 of the contract, and the Purchasing Department has
found them in default of their contract; and
WHEREAS, award is recommended to BCLS Landscaping Group, Inc., the next lowest responsive
and responsible bidder, under the same prices, terms and conditions pursuant to Invitation for Bid No.
247232;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The award to McIntyre Maintenance, Inc., pursuant to Invitation for Bid No. 247232, is
rescinded, and the bid is awarded to BCLS Landscaping Group, Inc., the next lowest responsive and
responsible bidder, for Grounds Maintenance Services Citywide, for an initial contract period of two (2)
years, with the option to renew for two (2) additional one (1) year periods, with funds allocated from the
various sources of funds of the user department, subject to the availability of funds and budgetary
approval at the time of need.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}

{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
