HomeMy WebLinkAboutR-11-0373City of Miami Legislation Resolution: R-11-0373 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00793 Final Action Date: 9/27/2011 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ESTABLISHING A NEW SPECIAL REVENUE PROJECT ENTITLED: "OUT OF SCHOOL TIME SNACK PROGRAM 2011-2012" AND ACCEPTING AND APPROPRIATING FUNDS, IN AN ESTIMATED AMOUNT NOT TO EXCEED $239,491.20, CONSISTING OF A REIMBURSEMENT GRANT AWARD RECEIVED FROM THE FLORIDA DEPARTMENT OF HEALTH, BUREAU OF CHILDREN NUTRITION PROGRAMS, ADMINISTERING THE UNITED STATES DEPARTMENT OF AGRICULTURE CHILD AND ADULT CARE FOOD PROGRAM CDFA #10.558 (CHILD CARE FOOD PROGRAM); AUTHORIZING THE CITY MANAGER TO ACCEPT SAID REIMBURSEMENT GRANT AWARD AND TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO IMPLEMENT THE ACCEPTANCE OF AND COMPLIANCE WITH SAID GRANT AWARD; ALLOCATING SAID FUNDS FROM THE CHILD CARE FOOD PROGRAM TO THE CITY OF MIAMI'S OUT OF SCHOOL TIME SNACK PROGRAM FROM OCTOBER 2011 THROUGH SEPTEMBER 2012; AUTHORIZING THE EXPENDITURE OF FUNDS FOR THE OPERATIONS OF THE PROGRAM, WITH SUCH AUTHORIZATION REMAINING VALID AND OUTSTANDING EVEN IF THE ANTICIPATED AWARD IS REDUCED OR INCREASED. WHEREAS, the City of Miami's ("City") Department of Parks and Recreation requested funding from the Florida Department of Health, Bureau of Children Nutrition Programs ("State") as administrator for the United States Department of Agriculture ("USDA") Child and Adult Care Food Program (CFDA # 10.558) (the "Child Care Food Program") to support the Out of School Time Snack Program located at various City parks; and WHEREAS, pursuant to Resolution No. 10-0408, adopted September 23, 2010, the City Commission authorized the execution of an award package, including a Grant Award Agreement, to accept the grant; and WHEREAS, the City has been awarded another grant in the estimated amount not to exceed $239,491.20 to continue providing said services, which amount is determined by the number of children served and the reimbursement formula amounts permitted by the USDA to be administered by the State; and WHEREAS, said funds in the amount of $239,491.20 from the State must be appropriated; and WHEREAS, the City must execute an award package, including a Grant Award Agreement, to accept the grant and to comply with the terms and conditions of the Child Care Food Program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File Id: 11-00793 (Version: 1) Printed On: 10/18/2017 File Number: 11-00793 Enactment Number: R-11-0373 Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The following new Special Revenue Project is established and resources are appropriated as described herein: PROJECT TITLE: Out of School Snack Program 2011-2012 RESOURCES: Florida Department of Health, Bureau of Children $239,491.20 Nutrition Programs Administering the United States Department of Agriculture Child and Adult Care Food Program (CFDA #10.558) APPROPRIATION: Out of School Snack Program 2011-2012 $239,491.20 Section 3. The City Manager is authorized {1} to accept said reimbursement grant award and to execute the necessary documents, in a form acceptable to the City Attorney, to implement the acceptance of and compliance with said grant award for the purpose of funding the City's Out of School Time Snack Program in the estimated not to exceed amount of $239,491.20, from October 2011 through September 2012. Section 4. The expenditure of the reimbursement funds is authorized for the operations of the program, with such authorization remaining valid and outstanding even if the anticipated entitlement award is reduced or increased. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
