Purpose of Item: An Ordinance amending Section 55-10 of the City Code entitled `Building permits; issuance; restrictions; exceptions" to allow a permit to be issued for the construction, renovation or repair of non -habitable on -site improvements on unplatted land when said improvements are mandated by the City Charter, City Code or City Commission. Director City Manager Page 1 of 2 Background Information: The City Charter, City Code or the City Commission may mandate that certain non -habitable on -site improvements be constructed, renovated or repaired on land within the City. Such improvements may include installation of a fence to secure vacant property, construction of a bulkhead to protect property and waterways and construction of walkways to improve public access and safety. City Code Section 55-10 currently requires that land be platted prior to the issuance of a permit to construct all improvements other than a one -family detached dwelling. Platting regulates the subdivision of land and aids in the coordination of land development in the community in accordance with orderly physical patterns. Property owners of unplatted land may be unable to obtain the necessary permit to comply with the mandate to construct the non -habitable on -site improvement. In addition, some unplatted land may not meet the technical requirements necessary to plat the land. The City mandate to construct certain non -habitable on -site improvements places the owner of unplatted land in an inequitable position if the owner is unable to obtain the necessary permit. In order to rectify this inequity, it is respectfully recommended that the City Code be amended to allow owners of unplatted property to obtain a permit to construct non -habitable on -site improvements mandated by the City.
