Director City Manager Page 1 of 2 w�C Background Information: Construction activities that cause the partial or full obstruction of streets, sidewalks and swales for extended periods of time disrupt vehicular and pedestrian traffic circulation, and access to a neighborhood and local businesses. The obstructions present a significant inconvenience to neighborhood residents, business owners, and the travelling public; and it is in the best interest of the City and the users of public rights -of -way to keep the duration of the obstructions to a minimum. The City Code currently provides a fee schedule for the use of the right-of-way related to the obstruction of streets, sidewalks and swales caused by construction activities, in order to help defray the cost of City staff to process, monitor and inspect permits over extended periods of time. The proposed Ordinance will amend the City Code mandated duration of time a permit for the use of a street, sidewalk or swale for construction related activities is allowed, and which will be subject to a non-refundable fee. The City Code currently requires a fee for such permits that exceed one month in duration. It is respectfully recommended that this duration be reduced; and that the current schedule of a non-refundable fee for a permit to obstruct a street, sidewalk or swale by construction activities apply to construction activities that exceed 5 days in duration.
