A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ESTABLISHING A NEW SPECIAL REVENUE PROJECT ENTITLED: "PROGRAMS
FOR THE DEVELOPMENTALLY DISABLED, 2011-2014," APPROPRIATING
FUNDS FOR ITS OPERATION, AND AUTHORIZING THE CITY MANAGER TO
ACCEPT ANTICIPATED PAYMENT FOR SERVICES IN THE ESTIMATED TOTAL
AMOUNT OF SIX HUNDRED THOUSAND FIVE HUNDRED AND EIGHTY ONE
DOLLARS, FROM THE STATE OF FLORIDA AGENCY FOR HEALTH CARE
ADMINISTRATION ("AHCA"), MEDICAID PROGRAM DEVELOPMENT;
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND TO EXECUTE A
MEDICAID WAIVER SERVICES AGREEMENT, IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY, WITH AHCA, TO FUND, ON A REIMBURSEMENT BASIS,
SUBJECT TO STATE APPROPRIATIONS, SERVICES AND PROGRAMS FOR THE
DEVELOPMENTALLY DISABLED ADMINISTERED BY THE CITY OF MIAMI'S
DEPARTMENT OF PARKS AND RECREATION, DURING THE PERIOD OF JULY
1,2011 THROUGH JUNE 30, 2014; AUTHORIZING THE CITY MANAGER TO
EXECUTE, SUBJECT TO APPROVAL BY THE CITY ATTORNEY, ALL OTHER
NECESSARY DOCUMENTS TO ACCEPT SAID FUNDS AND TO COMPLY WITH
SAID AGREEMENT.
WHEREAS, the City of Miami ("City"), through it's Department of Parks and Recreation,
obtains funds to support its Home and Community -Based Services ("HCBS") and Family and
Supported Living ("FSL") programs through the State of Florida Agency for administered by the
Florida Agency for Persons with Disabilities ("APD"); and
WHEREAS, AHCA, through APD, is providing funds to the City, on a reimbursement basis, in
the estimated amount of two hundred thousand, one hundred and ninety-four dollars ($200, 194) per
year, for a three-year period, commencing July 1, 2011 through June 30, 2014, for HCBS and FSL
services and programs being provided and to be provided within the City to developmentally disabled
individuals, for an estimated total amount of six hundred thousand five hundred and eighty-one
dollars ($600,581); and
WHEREAS, the City previously entered into the prerequisite Medicaid Provider Agreement
and has received a Medicaid Provider number; and
WHEREAS, APD has requested the City execute a new Medicaid Waiver Service Agreement
in order to continue HCBS and FSL programs and services previously administered under the earlier
Medicaid Provider Agreement; and the City is in the processes of negotiating certain provisions of the
new Medicaid Provider Agreement with APD that will need to be completed and executed before the
City Commission returns in September in order to continue AHCA funding to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,

FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The following new Special Revenue Fund is established as described herein:
FUND TITLE: PROGRAMS FOR THE DEVELOPMENTALLY DISABLED 2011-2014
RESOURCES: STATE OF FLORIDA AGENCY FOR HEALTHCARE ADMINISTRATION
MEDICAID PROGRAM DEVELOPMENT THROUGH STATE OF FLORIDA
AGENCY FOR PERSONS WITH DISABILITIES $600, 581
APPROPRIATION: PROGRAMS FOR THE DEVELOPMENTALLY $600,581
DISABLED, 2011-2014
Section 3. The City Manager is authorized {1} to accept anticipated payment for services in
the estimated total amount of six hundred thousand five hundred and eighty one dollars ($600,581)
from and to negotiate and execute a Medicaid Waiver Services Agreement ("Agreement"), in a form
acceptable to the City Attorney, with the AHCA, to fund, on a reimbursement basis, subject to state
appropriations, services and programs within the City for the developmentally disabled which are
administered by the City's Department of Parks and Recreation, during the period of July 1, 2011
through June 30, 2014.
Section 4. The City Manager is authorized {1} to execute, subject to approval by the City
Attorney, all other necessary documents to accept said funds and to comply with said Agreement.
Section 5. The Resolution shall become effective immediately upon it adoption and signature
of Mayor. {2}

{1} The herein authorization is further subject to compliance with all requirements that may be imposes
the City Attorney, including but not limited to those prescribed by applicable City Charter and Code prc
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
