HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00604 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT A TOTAL AMOUNT OF NOT TO EXCEED $419,321 , IN THE FORM OF ONE (1) REIMBURSEMENT GRANT ("GRANT") FROM THE CHILDREN'S TRUST ("TRUST") TO THE CITY OF MIAMI'S ("CITY") DEPARTMENT OF PARKS AND RECREATION ("DEPARTMENT") FOR THE HEART OF OUR PARKS OUT OF SCHOOL PROGRAM ("PROGRAM"); ESTABLISHING A NEW SPECIAL REVENUE PROJECT ENTITLED: "THE CHILDREN'S TRUST GRANT FOR PARKS 2011-2012," TO FUND THE DEPARTMENT'S PROGRAMATAFRICAN SQUARE PARK, JOSE MARTI PARK, JUAN PABLO DUARTE PARK, SHENANDOAH PARK AND WEST END PARK, WITH IN -KIND SERVICES FROM THE CITY VALUED AT NOT TO EXCEED $309,160 ("CITY MATCH"); APPROPRIATING THE GRANT FUNDS AND THE CITY MATCH; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND TO EXECUTE, AFTER CONSULTATION WITH THE CITY ATTORNEY, AN AGREEMENT WITH THE TRUST ("THE CHILDREN'S TRUST CONTRACT") AND TO EXECUTE ALL OTHER NECESSARY AMENDMENTS, EXTENSIONS, AND MODIFICATIONS AFTER CONSULTATION WITH THE CITY ATTORNEY, TO IMPLEMENT THE ACCEPTANCE OF AND COMPLIANCE WITH THE GRANT AWARD FOR SAID PURPOSES FOR THE PERIOD COMMENCING AUGUST 1, 2011 THROUGH JULY 31, 2012, WITH THE OPTION TO RENEW FOR UP TO TWO (2) ADDITIONAL SIMILAR PERIODS AT THE SAME NOT -TO -EXCEED AMOUNTS UNDER THE SAME TERMS AND CONDITIONS SUBJECT TO CONSULTATION WITH THE CITY ATTORNEY AND SUBJECT TO BUDGETARY APPROVAL. WHEREAS, the City of Miami's ("City") Department of Parks and Recreation ("Department") has been awarded one (1) reimbursement grant from The Children's Trust for Out of School Programs in the total amount of not to exceed-$419,321 for the Heart of Our Parks, Children's Trust, Out of School Program ("Program") and the City and The Children's Trust ("Trust") are negotiating the form of contract ("The Children's Trust Contract") for said purposes; and WHEREAS, the Program is comprised of a cooperative effort between the Department and three (3) not -for -profit organizations: Amigos for Kids, Arts for Learning, and the Miami -Dade Family Learning Partnership, and WHEREAS, the goal of the Program is to improve the overall health, well-being and academic achievement of children and the decrease of their involvement in behaviors that may put them at risk; and WHEREAS, previously pursuant to Resolution No. 10-0403, adopted September 23, 2010, and City of Miami Page 1 of 3 File Id: 11-00604 (Version: 1) Printed On: 7/15/2011 File Number: 11-00604 Resolution No. 10-0405, adopted September 23, 2010, the City Commission authorized the execution award packages for the Program, including the grant award agreements, to accept the grants; and WHEREAS, the City has now been awarded one (1) grant in the amount of not to exceed $419,321 for the Program to continue services during school year 2011-2012 commencing August 1, 2011 through July 31, 2012; and WHEREAS, the City must execute one (1) award package including the new form of The Children's Trust Contract, to accept the grant in order to enter into similar professional service agreements with the not -for -profit organizations in order to comply with the Trust's requirements; and WHEREAS, Amigos for Kids was determined to be the most advantageous not -for -profit organization and in the City of Miami's best interest to provide to provide program management, teacher supervision, family events, and other such activities at Jose Marti Park; and WHEREAS, Arts for Learning was determined to be the most advantageous not -for -profit organization and in the City of Miami's best interest to provide art, music, drama and dance instruction at African Square Park, Juan Pablo Duarte Park, Shenandoah Park and West End Park; and WHEREAS, Miami -Dade Family Learning Partnership was determined to be the most advantageous not -for -profit organization and in the City of Miami's best interests to provide literacy instruction, teacher supervision, and family literacy activities at African Square Park, Juan Pablo Duarte Park, Shenandoah Park and West End Park; and WHEREAS, the City Manager and the Department by separate resolution today, after a required public hearing, are requesting for the City of Miami Commission to authorize the City Manager to execute Service Authorization Letters and to negotiate and execute Professional Service Agreements ("Agreements") in compliance with the -final form of The Children's Trust Contract, respectively, with Amigos for Kids, for an amount not to exceed $68,758.60, Arts for Learning for an amount not to exceed $43,776 and the Miami -Dade Family Learning Partnership for an amount not to exceed $86,281.10 for the period of August 1, 2011 through July 31, 2012 with the option to extend for two (2) additional similar periods for the,same not -to -exceed amount; and WHEREAS, the City Manager and the Department are requesting the appropriation of said grant funding and the required City match in a not to exceed amount of $309,160 for these Agreements with the respective not -for -profit organizations (as indicated above) for the initial Fiscal Year 2011-2012, with future Fiscal Year funding subject only to consultation with the City Attorney and budgetary approval; NOW THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference incorporated as if fully set forth in this section. Section 2. The City Manager is authorized {1} to accept a total amount of not to exceed $419,321, in the form of one (1) reimbursement grant ("Grant") from The Children's Trust ("Trust") to the City of Miami's ("City") Department of Parks and Recreation ("Department") for the Heart of Our Parks Out of School Program ("Program") at African Square Park, Jose Marti Park, Juan Pablo Duarte City of Miami Page 2 of 3 File Id: 11-00604 (Version: 1) Printed On: 7/15/2011 File Number: 11-00604 Park, Shenandoah Park, and West End Park, with in -kind services from the City valued at not to exceed $309,160 ("City Match"). Section 3. The following new Special Revenues Project is established and resources are appropriated for the Program as described below: PROJECT TITLE: The Children's Trust Grant for Parks 2011-2012 RESOURCES: The Children's Trust $419,321 City Match $309,160 APPROPRIATION: The Children's Trust Grant for Parks 2011-2012 $728,481 Section 4. The City Manager is further authorized{1}'to negotiate and to execute, after consultation with the City Attorney, an agreement with the Trust ("The Children's Trust Contract") and to execute all other necessary amendments, extensions, modifications after consultation with the City Attorney to implement acceptance of and compliance with the Grant award for said purposes for the period commencing August 1, 2011 through July 31, 2012 with the option to renew for up to two (2) additional similar periods at the same not to exceed amounts under the same terms and conditions subject to consultation with the City Attorney and subject to budgetary approval. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS JULIE O. BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subjected to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} if the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
