HomeMy WebLinkAboutPre-LegislationCity of Miami Legislation Resolution: R-10-0326 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 10-00834 Final Action Date: 7/22/2010 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 5 TO THE USE AGREEMENT WITH TVM PRODUCTIONS, INC. ("TVM"), IN SUBSTANTIALLY THE ATTACHED FORM, ALLOWING TVM TO CONTINUE FILMING THE TELEVISION SHOW "BURN NOTICE" AT THE COCONUT GROVE EXPOSITION CENTER THROUGH SEPTEMBER 30, 2011, WITH A ONE (1) YEAR OPTION TO RENEW, AT THE DISCRETION OF THE CITY MANAGER SUBJECT TO CITY COMMISSION APPROVAL. WHEREAS, TVM Productions, INC.'s ("TVM") filming of the television show "Burn Notice" at the Coconut Grove Exposition Center provides employment to many City of Miami ("City") residents in the entertainment industry; and WHEREAS, Burn Notice supports local City businesses that supply lumber, vehicles, and dozens of other items for its production; and WHEREAS, the economic climate is such that many Miami -based film, television and video production companies are on the brink of failure if Burn Notice leaves the City; and WHEREAS, Burn Notice's producer has stated that no location has been identified in the City to meet the 100,000 square foot production space located within the Coconut Grove Exposition Center; and WHEREAS, it would send a negative message to the filming industry looking to locate in the City, if the City were to turn away Burn Notice when dozens of cities and states are creating multimillion dollar incentives to lure entertainment productions; and WHEREAS, this City Commission remains firmly committed to ultimately razing the Coconut Grove Exposition Center and creating parkland once the building is no longer used for film or television production; and WHEREAS, the basic Use Fee TVM pays for the use of the Coconut Grove Exposition Center shall be $20,000 per month commencing September 1, 2010 through September 30, 2011; and WHEREAS, the Use Fee shall be allocated for use solely to support the Coconut Grove Exposition Center Master Plan, for waterfront improvements; and City of Miami Page 1 of 2 File Id: 10-00834 (Version: 2) Printed On: 8/19/2010 File Number' 10-00834 Enactment Number: R-10-0326 WHEREAS, TVM shall be fully responsible for all utilities associated with the building, regular lawn service, tree trimming, pest control, fire alarm maintenance and monitoring, fire extinguisher servicing, and other building expenses as required by the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute Amendment No. 5 to the Use Agreement with TVM, in substantially the attached form, to allow TVM to continue filming the television show "Burn Notice" at the Coconut Grove Exposition Center for am additional thirteen (13) months commencing September 1, 2010 through September 30, 2011, with a one (1) year option to renew at the discretion of the City Manager, subject to City Commission approval. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
