HomeMy WebLinkAboutR-11-0280City of Miami Legislation Resolution: R-11-0280 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00572 Final Action Date: 7/14/2011 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT ("LEASE"), IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND GROVITES UNITED TO SURVIVE, INC., A FLORIDA CORPORATION, FOR THE LEASE OF REAL PROPERTY LOCATED AT 3686 GRAND AVENUE, MIAMI, FLORIDA, FOR THE PURPOSE OF ESTABLISHING A RECREATIONAL FACILITY FOR THE MIAMI POLICE ATHLETIC LEAGUE PROGRAM, FOR A ONE (1) YEAR PERIOD, WITH FIVE (5) OPTIONS TO RENEW FOR ADDITIONAL TERMS OF ONE (1) YEAR EACH; ALLOCATING FUNDS FROM THE MIAMI POLICE ATHLETIC LEAGUE ACCOUNT, WITH ADDITIONAL TERMS AND CONDITIONS AS MORE PARTICULARLY SET FORTH IN THE LEASE; FURTHER AUTHORIZING THE CITY MANAGER TO APPROVE AND EXECUTE ALL NECESSARY, NON -SUBSTANTIVE AMENDMENTS TO SAID LEASE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY. WHEREAS, Grovites United to Survive, Inc. ("Lessor"), a Florida corporation, is the owner of approximately 3,197 square feet of real property located at 3686 Grand Avenue, Miami, Florida ("Premises"); and WHEREAS, the City of Miami ("Lessee") desires to operate a recreational facility to train, coach and teach the youth of Coconut Grove, and the general public, the sport of boxing under its Miami Police Athletic League Program; and WHEREAS, Lessee and Lessor have negotiated the terms of an agreement to lease the Premises ("Lease"), at a rate of $5.07 per square foot, or $1,350 per month, for a one (1) year period, with five (5) options to renew for additional terms of one (1) year each, subject to rent increases as provided in Section 3(D) of the Lease; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute a Lease, in substantially the attached form, between the Lessee and the Lessor, for the Lease of the Property, for the purpose of establishing a recreational facility for the Miami Police Athletic League Program, with a monthly rent of $1,350 ($5.07 per square foot), for a one (1) year period, with five (5) options to renew for additional terms of one (1) year each, with funds allocated from the Miami Police Athletic League Account, with additional terms and conditions as more particularly set forth in the Lease. The City Manager is further authorized{1} to approve and execute all necessary, non -substantive amendments to said Lease, in a form acceptable to the City Attorney. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
