HomeMy WebLinkAboutR-11-0275City of Miami Legislation Resolution: R-11-0275 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00542a Final Action Date: 6/23/2011 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THAT ADMINISTRATIVE POLICY MANUAL POLICY 1-86: "SEVERANCE POLICY", AS REVISED SEPTEMBER, 2010, BE THE OFFICIAL POLICY BY WHICH THE CITY OF MIAMI MAY PROVIDE SEVERANCE PAY TO UNCLASSIFIED PERSONNEL APPOINTED BY THE CITY MANAGER TO POSITIONS HOLDING EXECUTIVE STATUS, UNTIL SUCH TIME AS THE MIAMI CITY COMMISSION ADOPTS AN ORDINANCE THAT SUPERSEDES SAID APM. WHEREAS, Administrative Policy Manual ("APM") Policy 1-86, entitled "Severance Policy" set forth severance considerations including a provision that severance pay not be given if: 1. The employee voluntarily resigns; or 2. The employee retires; or 3. Termination of an employee is for cause, including malfeasance, nonfeasance, or misfeasance; and WHEREAS, it is in the best interest of the City of Miami that the provisions of APM Policy 1-86 be strictly applied unless the City Commission determines otherwise; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami City Commission directs that APM Policy 1-86: "Severance Policy", as revised September, 2010, be the official policy by which the City of Miami may provide severance pay to unclassified personnel appointed by the City Manager to positions holding executive status, until such time as the Miami City Commission adopts an ordinance that supersedes said APM. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
