Thompson, CMC City Clerk DATE : June 13, 2011 FILE : SUBJECT : Certification of the Official Results of the MiMo BIC's May 27, 2011 Petition Process REFERENCES: ENCLOSURES: Certification of BIC Petition Process Enclosed is the official certification of the results of the MiMo Business Improvement Committee's (BIC) petition process to create the MiMo Business Improvement District (BID). On Thursday, December 16, 2010 the Commission passed Resolution 10-0559 establishing a special assessment district to be known as the MiMo BID and authorizing the levy and collection of a special assessment for a period of three (3) years, subject to the approval of a majority of the affected property owners. The MiMo BIC opted to obtain approval of the affected property owners through a petition process. Per agreement between the MiMo BIC, the Office of the City Attorney and the Office of the City Clerk, this process included affidavits and petitions to be filed with the Clerk by 5:00 PM, Friday, May 27, 2011. The MiMo BIC mailed affected property owners within the MiMo area packets of information including: general information about business improvement districts and the MiMo area; the assessment roll; blank affidavits; and petitions and filing instructions. On Friday, May 27, 2011, at 5:00 PM, the agreed upon deadline for the Clerk to have received affidavits and petitions from owners of the seventy-three (73) affected properties of the proposed MiMo BID, a total of thirty-nine (39) affidavits had been filed with the Office of the City Clerk. Of the thirty-nine (39) affidavits filed, only five (5) affidavits were determined to be properly executed and valid. The number of valid affidavits filed represented 6.85% of the affected properties within proposed special assessment district and therefore, did not represent a majority of the affected property owners stipulated by Resolution 10-0559. c : Tony E. Thompson, City Clerk of the City of Miami, Florida do hereby certify that all necessary legal steps were taken in connection with the conduct of the petition process carried out by the MiMo Business Improvement Committee (MiMo BIC) to create the MiMo Business Improvement District (MiMo BID). The MiMo BIC opted to obtain approval of affected property owners through a petition process that included having property owners file an affidavit with a signature of the property owner, or their designee, to be filed with the Office of the City Clerk (Clerk) by 5:00 PM on Friday, May 27, 2011; and, a petition circulated by the MiMo BIC to be filed with the Clerk by 5:00 PM on Friday, May 27, 2011. I. On Thursday, December 16, 2010 A. The City Commission of the City of Miami passed Resolution 10-0559 establishing a special assessment district to be known as the MiMo BID and authorizing the levy and collection of a special assessment for a period of three (3) years, subject to the approval of a majority of the affected property owners of all properties abutting Biscayne Boulevard from NE 63rd Street in the South to NE 76th Street in the North, including the City of Miami's Legion Memorial Park. B. The petition process, per agreement between the MiMo BIC, the Office of the City Attorney and the Clerk, included affidavits to be filed with the Clerk by Friday, May 27, 2011, no later than 5:00 PM and petitions to be filed with the Clerk no later than 5 PM on Friday, May 27, 2011. C. The MiMo BIC mailed affected property owners, within the MiMo area as described in I. A. above, packets of information including general information about business improvement districts, the MiMo area, the assessment roll, blank affidavits and petitions, and filing instructions. II. I further certify that on Friday, May 27, 2011, at 5:00 PM, the agreed upon deadline for the Clerk to have received affidavits from the owners of the seventy-three (73) 1 affected properties of the proposed MiMo BID, a total of thirty-nine (39) affidavits had been filed with my Office. III. Five (5) affidavits, of the thirty-nine (39) filed affidavits were determined to be properly executed and valid. Thirty-four (34) of the thirty-nine (39) filed affidavits were determined to be improperly executed and therefore invalid. IV. I further certify that the five (5) valid affidavits filed represent 6.85% of the properties within proposed special assessment district and therefore do not represent a majority of the affected property owners stipulated by Resolution 10-0559.
