DUNN II Agenda Item: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 2/ARTICLE XI/DIVISION 7 OF THE CODE, AS AMENDED, ENTITLED "ADMINISTRATION/ BOARDS, COMMITTEES, COMMISSIONS/OVERTOWN ADVISORY BOARD/OVERTOWN COMMUNITY OVERSIGHT BOARD," MORE PARTICULARLY BY AMENDING SECTION 2-1052(2)(F). Subject: VACANCY APPOINTMENT OVERTOWN ADVISORY BOARD/OVERTOWN COMMUNITY OVERSIGHT BOARD Impact: DISTRICT 5 Purpose of the Item: When a vacancy occurs the District 5 Commissioner needs to be able to act quickly to fill the void by having the authority, pursuant to ordinance, to appoint a person of his choosing exclusive of the stale names submitted for appointment. Background Information: Presently when a vacancy occurs the ordinance limits the Commissioner's appointment to those that have submitted application pursuant to an advertisement similar to what is used to fill the Planning and Zoning Board. More specifically, the ordinance requires that no appointment shall be made unless notice has been given in a newspaper of general circulation at least 30 days prior to aappointment and the appointee has submitted their name for consideration to serve on the Overtown Community Oversight Board. This process prolongs filling a vacancy, because of the thirty (3o) day advertisement! requirement, adds to the city a cost of advertising, and limits the commissioner. appointment to a stale list; D5 Agenda Summary Memo 04.09.11
