HomeMy WebLinkAboutPlanning AnalysisPLANNING DEPARTMENT ANALYSIS Case No. 2011- 00318sc CLOSING, VACATING, ABANDONING AND DISCONTINUING FOR PUBLIC USE THAT PORTION OF A STREET LOCATED ALONG THE WEST SIDE OF NORTHEAST 2ND AVENUE BETWEEN NORTHEAST 38TH STREET AND NORTHEAST 39TH STREET. Pursuant to Section 55-15 (c) of the Miami City Code, the Planning Department has reviewed the proposed public right-of-way vacation and closure to determine whether it is in the public interest, or whether the general public would benefit from the vacation of the right-of-way. The following findings have been made: • It is found that this application was presented to the Plat and Street Committee and was denied with a vote of 0 in favor and 9 in denial. • It is found that N.E. 1 Court is currently utilized for vehicular and pedestrian access throughout the design district. • It is found that N.E. 1 Court is used for access and parking. The roadway is fully utilized by Police, Fire and other emergency vehicles. The roadway serves as an optional route for Fire -Rescue vehicles to shorten response time. • The proposed development is tentative and continuing to utilize the existing buildings are better served with the existing roadway remaining open. • It is found that the property owner has failed to demonstrate any public benefits that would be provided as result of the proposed street vacation. Based on these findings, the Planning Department recommends denial of the request.
