HomeMy WebLinkAboutPlanning AnalysisPLANNING DEPARTMENT ANALYSIS Case No. 2011- 00320ac CLOSING, VACATING, ABANDONING AND DISCONTINUING FOR PUBLIC USE THE ALLEY LOCATED BETWEEN NORTH MIAMI AVENUE AND NORTHEAST MIAMI COURT, AND BETWEEN NORTHEAST 16TH STREET AND NORTHEAST 17TH STREET. Pursuant to Section 55-15 (c) of the Miami City Code, the Planning Department has reviewed the proposed public right-of-way vacation and closure to determine whether it is in the public interest, or whether the general public would benefit from the vacation of the right-of-way. The following findings have been made: • It is found that the closure of the alley will permit cohesive development of several large tracts within the block and bring revitalization and stability to the neighborhood. • It is found that the northerly end of the alley closure was approved by the City Commission on February 10, 2005 by Resolution 05-0106. However, because the applicant failed to finalize the platting process due to economic conditions, the approval for the alley closure expired. The property owners subsequently obtained building permits and have constructed a condominium tower on and over the entire north end of the alley, physically closing the alley to all access. • It is found that the alley provides for emergency access to the adjacent properties. • It is found there would be no adverse affect on the ability to provide emergency service to the property with the closure of the alley if an emergency access easement along the south side of proposed Tract "A" is provided from North Miami Avenue to N.E. Miami Court. • It is found that the alley is not part of the vehicular or pedestrian circulation grid for the neighborhood and, due to encroachments within the alley, is not utilized by the general public for access. • It is found that the Plat and Street Committee voted 9 in favor and 0 in denial of the request to close and vacate the alley subject to the provision of an emergency access easement approved by the City of Miami Fire -Rescue Department Based on these findings, the Planning Department recommends approval of the request with conditions. 1. Provide an emergency easement conforming to the City of Miami Fire Department's requirement (location and dimensions).
