W. 2nd Avenue, Third Floor Miami, FL 33130-1910 Re: Application for Rezoning 3242 Charles Avenue Dear Mr. Garcia: I represent 3242 Charles LLC and Stirrup Properties, Inc.., the lessee and owner respectively of the property at 3242 Charles Avenue. My clients seek to rezone the property from T3R (Suburban Zone -Restricted) to T4L (General Urban Zone -Limited) to allow for the adaptive re -use of an historic structure -- the Stirrup House. This'will be the first step in effecting the restoration of this historic structure. The neighborhood surrounding this property is characterized by institutional uses to the north and east (Coconut Grove Playhouse and parking lot), Commercial and residential uses along Main Highway and Charles Avenue to the east and south (Regions Bank, Calamari Restaurant, Camp Biscayne single-family development and Grove Garden condominium), the historic Stirrup House to the south and single-family residential to the west along Charles Avenue. This property is bounded on two sides by commercial uses and includes a designated historic structure. This rezoning is for the purpose of allowing the adaptive re -use of the historic structure. The rezoning will enable the restoration of the house and the preservation of an important piece of Coconut Grove and Miami history. The preservation of this house through the adaptive reuse that the rezoning will allow is consistent with the character of this area as a transition between the single- family neighborhood to the west and the commercial and institutional properties on Main Highway to the north and east. 1 REZONING APPLICATION MIAMI 21 1(-.GDIt5e2c, The deadline to file the complete application with supporting documents is the first five working days of each month from 8:00 am until 3:00 pm, except on the fifth day, at 12:00 pm. The application submittal date is the date stamped by Hearing Boards' staff on this page. The responses to this application must be typed and signed in black ink. All pertinent and accurate information/documentation; i.e., the plans, reports, exhibits, shall be presented at the time of filing, in addition to the paid receipt. The applicant is responsible for the accuracy of the information contained in the application and all supporting materials. Should you wish, you could bring the materials to our office for review before the deadline to ensure completeness. You will be responsible, if needed, to bring an interpreter for the English language to any presentation before city boards, committees and the city commission. A valid power of attorney will be required if neither applicant or legal counsel representing the applicant execute the application or desire to make a presentation before city boards, committees and the city commission. ORDINANCE NO. 11469, CODIFIED IN CHAPTER 2, ARTICLE VI OF THE CITY CODE STATES THAT ANY PERSON WHO RECEIVES COMPENSATION, REMUNERATION OR EXPENSES FOR CONDUCTING LOBBYING ACTIVITIES TO REGISTER AS A LOBBYIST WITH THE CITY CLERK, PRIOR TO ENGAGING IN LOBBYING ACTIVITIES BEFORE CITY STAFF, BOARDS, COMMITTEES AND THE CITY COMMISSION. The property is primarily surrounded by T4L and T5L zoned properties along its eastern and southern edges and by another T3R site along its western edge. 2. As a historic site, and because it is adjacent to commercially zoned properties, the use of the property as a true single family residence is very limited. 3. The current T3R zoning classification is inappropriate in that it will not allow for appropriate uses that will ensure the preservation of this historic property. 4. The current zoning does not allow for adaptive reuse of historic structures thus the T3R zoning is an impediment for preservation of historic structures in this area.
