HomeMy WebLinkAboutLegislation SR 05-26-11City of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 11-00344 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 54/ARTICLE II OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/CONSTRUCTION, EXCAVATION AND REPAIR," TO INCLUDE A WAIVER OF PERMIT FEES PROCEDURE FOR CERTAIN MIAMI-DADE COUNTY PUBLIC WORKS DEPARTMENT ROADWAY IMPROVEMENT PROJECTS; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING. FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS, Chapter 54, Article II of the Code of the City of Miami, Fiorida, as..amended, ("Code") provides the permit fee schedule for roadway and underground utility improvements; and WHEREAS, the Miami -Dade County Public Works Department ("County") constructs, reconstructs and maintains roadways under the jurisdiction of the County within the limits of the City of Miami ("City") at no cost to the City; and WHEREAS, County improved and maintained roadways beneficially serve the residents of the City; and WHEREAS, the County derives no revenue directly from the construction, reconstruction or maintenance of said roadways; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 54/Article II of the Code entitled "Streets and Sidewalks/Construction, Excavation and Repair," is amended in the following particulars:{ 1) "CHAPTER 54 STREETS AND SIDEWALKS ARTICLE II. CONSTRUCTION, EXCAVATION AND REPAIR Sec. 54.43. Permit fee for street excavation, sidewalk repair, paving or resurfacing of parkway or City of Miami Page 1 of 2 File Id: 11-00344 (Version: 1) Printed On: 5/6/2011 File Number: 11-00344 shoulder area, building line and grade survey, sidewalk construction survey, driveway construction, flume excavation, utility placement; underground utility service connection excavation, groundwater monitoring wells; permit renewal; after -the -fact permit, and reinspection fees: waiver of fees. (d) Permit fees under this section may be waived, in writing, by the City Manager or designee for roadway improvement projects by the Miami -Dade County Public Works Department that are not a component of, or ancillary to the construction, maintenance or repair of revenue producing facilities in the public right of way. (e) This section shall be annually reviewed by the City Commission at the time of adoption of the budget. *II Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective immediately upon Its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS JULIE O.
